His uniform ‘might offend people.’<br />The security personnel hired by the school told the 24-year veteran Lt. Col. After big hugs and high fives and the kids are ALL inside, I get "escorted" to the principle and I don't leave until we get to the origination of the policy. I have never sued anyone for anything but this calls for an attorney. I get an attorney on retainer and take no action until I make sure my C of C knows exactly what transpired and advise them that I have already attained counsel. My blood was boiling! But, as I am a professional, I counted to 10 and thought the same thing that most of you have already stated. Best thing to do is to turn around and take the issue up with the proper school authorities. Of course, I'd be sure to invite the local press to join in my conversation as the principal, the superintendent and the school board try to explain and justify this egregious abuse of power. I might even have to contact my attorney in light of the severe emotional trauma my children and I suffered from the security guard's actions and words. B. 236791 <div class="images-v2-count-0"></div>As I commented on in response to another member's comments....<br /><br />I believe everyone's first reaction would be to make a scene and demand entry, however, that would just have escalated the problem. The best course is to be calm and comply, but follow-up in a professional and rational manner with someone in authority over that person. Especially when one is in uniform.<br /><br />Clearly, the security guard was wrong and was not enforcing a school policy. I believe the Superintendent made that clear and did the right thing.<br /><br />As a Military Police officer, I have had to "clean up" some messy situations, many involving senior NCOs and officers who got sideways with MPs on duty. While, technically, they may have been correct, when they started arguing with or refusing to follow the legal instructions of an MP (most times much junior in rank) and the situation escalates, they are generally the ones who bear the brunt of the "at fault" findings and the repercussion that follow. I have, more times than I can recount, had to pull out an Army or local regulation that stated "Military Police on duty will not be corrected, reprimanded or given instructions by anyone other than their Military Police chain of command" or words to that effect.<br /><br />The same is true for dealing with civilian law enforcement and, in most instances, commercial security guards. If you argue with their instructions, more times than not, you are going to lose. It is better to simply comply and take it up with their supervisors.<br /><br />I have always hated the statement used by MPs "Don't confuse your rank with my authority" and have recommended against using it, however, it actually defines the situation that exists in many cases. Then up the chain of authority, Dean of security, VP/AP of the school, and finally the local top authority, the Principal. My mother retired as an LAUSD Area Superintendent, and she told me about an incident with the school police where the frontline "doorkeeper" at a local high school, refused to allow admittance to the School Police in Uniform, unless they sign in on the school's sign in sheet. That is required at ALL LA Unified Schools, and is a longstanding policy for anyone who is classified as a "visit," not permanently assigned staff, teachers or classified employees, or volunteers who have been background checked and issued school IDs. So the school cops refused to sign in (they are special you know). Bottom line, they are refused entry to the campus, and the school employee was on the phone with their supervisor at their headquartered before their shadows had exited the property! They were "counseled" for their attitude and failure to abide by school district policy. If the security guard cannot cite a clear policy for refusing admittance to Military in Uniform, he is acting outside of the scope of his authority, and he will be quickly reversed. Keep your cool, move up the food chain until you are dealing with someone in greater authority than the security guard, and you will eventually find someone who will be reasonable or will clearly cite to a school district written policy that justifies your prohibition while in uniform. At that point this is a situation for the school district's legal counsel, and it is probably a policy decision that needs to be addressed at the School Board's Next Meeting. One thing the fact scenario did not mention is whether or not, the school guard did or did not ask to also see the Officer's CAC card/Military ID. As we all know there are unfortunately Posers and Impostors out there who wear a US Military Uniform, and who have never served in the military or due to the nature of their discharge are not allowed by regulation to wear a US Military Uniform. The schools district can turn a lemon into Lemonaid, by hosting an "Armed Forces Day" where recruiters, parents, and employees (lots of teachers are reservists or guardsmen or vets), are encouraged to wear their uniforms that one day a year, so that the students are not frightened by the sight of a US Armed forces uniform. When I was in school so much instruction time was wasted because teachers had to attend to disruptive kids/criminals. My kids should not have to compete with malcontents attending class only because they are legally obligated to. Start by removing the distraction and making hard decisions about alternative education for problematic kids. I would go before the school board and question the qualifications of those who would teach my child that pride in our nation and those who serve must be subordinated to the POSSIBILITY that someone might be offended. Our armed forces take great pride in the reputation of protecting the weak and innocent rather than being the agents of oppression. I would consider this the same thing as teaching our children to be fearful of police.
