Make sure that your flag gets lifted when it is supposed to be and you should need the six months time in grade before you make E3. Then after that you will be back on normal track for E4. I had a SGM who told us once that &quot;you don&#39;t get up without having fallen down&quot;. The strong implication was that, based on his experience, getting knocked down in rank--if you learn from it and don&#39;t repeat bad decisions--won&#39;t stop you from progressing in your career. However, if you&#39;re a fast tracker you can possibly get it back in three months. I have seen it happen this way but it will all depends on a couple of things one your chain of command don&#39;t hold any grudges towards you and two your performance has to be stellar.<br />Since you will already have time in service for your new rank you really don&#39;t need a waiver to be considered, but you may need one for the time in grade. Worst case scenario it takes the full six months. Stayed out a few years and came back a much more mature and better Soldier. I started over as a 30 year old Pv1. The &#39;how you pick yourself back up&#39; statement is SOLID FACT. 13 years later, I just pinned SFC. <br />I say this not to brag but as an example that you can and will move forward and excel but there&#39;s only one person that can do it, the guy staring back at you when you shave each morning. <br />Drive forward and don&#39;t just do the bare minimum, OVERDO EVERYTHING. And when you&#39;ve come back and made your goals, don&#39;t forget the lessons learned and pass them forward to your Soldiers. An E4 MP with an alcohol problem and an anger management problem beat another soldier so badly that he hospitalized him for one week. That&#39;s aggravated assault with grievous bodily injury. A felony and a court-martial. CID handled the investigation. The individual states that he was busted from E4 to E1 but within six months was an E4 again and a supervisor.<br /><br />Before I said anything I said that since he was an administrator I was going to withhold my comments at which time he told me that he would not seek retribution as the administrator for my comments.<br /><br />I quoted AR 600-8-10 to him at which time he banned me from a Facebook group. Time in service and time in grade don&#39;t change once you&#39;re busted down. A company grade Article 15 can only take one pay grade and a 7-Day suspension of pay. His court-martial was field grade and he lost 30 days pay plus a fine just stay out of jail.<br /><br />It&#39;s great to give advice to someone and hope that they look at it with optimism but what is the truth of the matter? Is it at all possible to be busted down on a felony conviction to E1 without 1. Not receiving a bad conduct discharge right then and there or 2. Not being reclassified or 3. Confinement for one year without pay, no rank, and then a bad conduct discharge.
