An O-5 was recently sentenced to 3 years in prison for bribery while in the service. Should he lose his retired pay?

I had a MAJ that I worked with do 11 yrs for various offenses involving defrauding the government and he is getting his retired pay....former enlisted.

He should be recalled to active duty, reduced to the last rank he served "honorably" at, and receive retirement based on his "new" rank.
As bad as it sucks, retired military members sentenced to prison do not lose their pensions as far as I can tell. I did find a VA reference that states they lose those benefits, or receive reduced benefits while they're incarcerated.
