Are there any new regulations effecting ARNG Open Vacancy Promotions?

Were there any new regulations implemented that effect an open vacancy promotion?
I heard before that when you're in E5 slot from an open vacancy, promotion points no longer apply to you. Now I'm hearing per new regulations, promotion points are taken into account and if you don't meet those standards, you won't be promoted. Is the latter statement true?

The latter statement has always been true.

If you heard otherwise, you heard it from someone who has never read AR 600-8-19.

No. As SGM Jeff Mccloud stated, it's never been that way.

NGB did standardize the requirements for Statewide Vacancy Announcements back in .. 2019/2020 I believe .. with a PPOM (reflected in the 2021 version of NGR 600-200* (Section IV) which outlined the process and requirement before a Soldier who didn't meet the promotion eligibility could be assigned to a position of the next higher rank ('assigned to', not 'assigned and promoted').

However, it explicitly states that while the Soldier can be assigned to a position, they will not be promoted until they meet all regulatory eligibility requirements, including integration on the current promotion list.

Looking back through the older version of NGR 600-200* from 2009*, the language used was "In the absence of qualified Soldiers in the correct grade for positions authorized in grades SGT through MSG, the immediate (or a higher level) commander should temporarily assign the best-qualified individual available. This assignment carries no permanence or guarantee of promotion in that position. The immediate or any higher level commander can assign a fully qualified individual (including one on a promotion list for promotion to the authorized grade) to that position at any time."
