Are there any ramifications on a District Attorney attempting to destroy your military career because you would not accept his plea deal?

The assistant district attorney has not only coerced supposed witnesses to make accusations that have nothing to do with the civil case against me. My current command, being that they are in contact with this district attorney, have initiated the process to chapter me and are now attempting to give me an article 15 for allegations made against me by my ex-wife who happened to have been coerced by the district attorney to do so. I am sure there has to be some type of statute that would protect me against such, yet my command is not too helpful on such situations.

This is a great question for Trial Defense or your JAG. I would not put this type of information on open forum. It could be construed as libel.

This is not the sort of thing where you want a barracks lawyer. Any leader worth their salt will tell you nothing more than to seek counsel. If it takes a 6 year degree to do it (lawyer, Doctor) it's safe to assume that nobody else should try.

Cold hard reality is there's a criminal process going on. DA's offer up plea deals to conserve their office resources and a likely overcrowded court docket. The Service is taking action because there is a criminal proceeding against you. That action would likely be concluded before a trial. The JAG works for the Service, not you. JAGs make their support decision on whether or not it's legally worth while or your CoC tossed a chill pill over his way.

Your choices are limited. Take a plea and you're gone anyways or go to trial and you're gone anyways. If you take the first option, that's the end of it less what the ruling says you have to do. Going to trial is a crap shoot as well. If you lose, you get hammered more. If you win, then you have two more options. First is get on with living your life. Second is seeking legal redress by a civil suit. Since you don't likely have deep pockets, then it would be a good attorney concluding a libel suit would likely prevail and he gets a cut of the award. It would rely heavily on proving misconduct by the DA office and false testimony of the witnesses. If you are found guilty at trial, similar aspects would be the subject for appeal.

If you legitimately didn't mess up and you are being buried then seek help with your Congressperson. If you know deep down that you messed up, take the beating otherwise making it congressional will only dig your grave deeper.
