While I can see there could still be commentary on impairment before signature and coercion, surely a signed consent document is more credible than a verbal agreement intrinsically? We're getting to the point where the only ironclad mutual consent will be video recording of the entire interaction, from initial meeting through parting, with multiple mentions of no impairment or coercion by both parties, demonstrations of competency prior to and following the act and repeated camera sweeps of the surrounding area before, during and after to show the context.

I think I've established my bona-fides elsewhere on related threads as a firm believer in consent and against assault, and in empowerment and protection of all people, but consent rules are becoming unattainable. Get a signed consent form. I have also stated that it doesn't mean things can't change, but it's best to be sure from the get go. I've mentioned checking your partner's identification to properly determine if they are of legal age before partaking in any bumping of naughty bits. I don't like the bottom part of this at all. That's dangerous and points towards this being thought of as a get out of jail free card, when it isn't even close. Bring that card in with a smug look on your face after being accused of rape and you'll likely make your situation much worse. Rape is one of the few subjects that I find off-limits for humor, as I was in a unit that had a sexual assault and watched what happened to the unit and the Soldier in question (a friend of mine).

That being said, those that consider this to be a good idea are lacking an understanding of the overall concept of rape. Sexual assaults/rape can begin with consensual sex and progress to rape. It can also begin with a person being under the influence of a drug like Rohypnol that makes people very cooperative, but I don't think anyone would argue that it would be a rape nonetheless. Various other drugs can reduce peoples abilities to accurately make decisions.

This card to me illustrates several major flaws we have in our society.

First, rape is a "male" problem. When I was a sophomore in college, a "friend" decided to use me as a way to get out of college, alleging that I assaulted her in her room. It very nearly ended my career had she pressed charges, as it was her word against mine. Fortunately, she didn't...and 3 months later she sent me an email admitting that she had lied about the assault because she was afraid of telling her parents that she was failing school. Bottom line, it can happen to men and women, and BY men or women. The statistics show that men are less likely to report it...but it is by no means unique to any gender.

Second, rape is not a joke. I get that the sexual harassment classes are obnoxious and annoying. Additionally, I understand that some of the SHARP representatives are oversensitive with regards to what is allowed. However, there is a vast difference between a slightly off color joke and making a joke or threat about raping someone. When I made the comment about this same card while it was circulating on facebook, commenting about the lack of humor in rape, the response was "It's a joke, not a dick. Don't take it so hard." Until we learn to take some things seriously, the problem will continue.

Third, the concept that we need a contract for everything, or that the contract is going to protect us. I know of several rape victims, and their stories are all different. One was raped while she was married. Her husband didn't like hearing "no" and decided he was going to do what he wanted anyways.

1SG Private RallyPoint Member , there are some commands considering these kinds of actions. It is to ensure “affirmative consent." I think if you are in a situation where you need a card to ensure you are not charged with a sex crime you shouldn't be there in the first place. I am a bit older and married so I know I wouldn't really be one for such a thing. But when I was a single paratrooper at Fort Bragg I didn't use alcohol to seduce a women. It is bad both ways. When I was a cop I learned a valuable lesson that applies in most cases. If you have to ask to clarify if you are wrong or not then you are most likely in the wrong. Even if a card was signed and the female claimed she was raped the other party would still be charged and this card wouldn't be able to be used as a means to defend the actions.

http://www.nytimes.com/2014/09/30/us/california-law-on-sex-consent-pleases-many-but-leaves-some-doubters.html?_r=0

Log In - The New York Times

To save articles or get newsletters, alerts or recommendations – all free.

CPT Private RallyPoint Member Tue, 06 Oct 2015 20:06:45 -0400 2015-10-06T20:06:45-04:00 Response by CPT Private RallyPoint Member made Oct 6 at 2015 8:07 PM https://www.rallypoint.com/answers/army-sex-consent-card?n=1021953&urlhash=1021953

Here is a video of how it should be done.

Consent (2004)

http://www.imdb.com/title/tt0402936/fullcredits#cast Daniel Dubiecki, Scott Ludden, David Tate, Jason Reitman, Michele Lee Cast: Todd Waldman, Rachel Vacca, ...

CPT Private RallyPoint Member Tue, 06 Oct 2015 20:07:43 -0400 2015-10-06T20:07:43-04:00 Response by SFC Michael Hasbun made Oct 7 at 2015 12:40 PM https://www.rallypoint.com/answers/army-sex-consent-card?n=1023706&urlhash=1023706

Obviously it's not a real product, but does that really mean it's a bad idea?
