Can a NCO reenlist in the Active Army with a relief for cause NCOER?

SFC Private RallyPoint Member AR 601–280 • 16 October 2019 Para 3-9 says that relief for cause is disqualifying but it may be waivable by the first O6 level commander in the chain of command.

"...(3) Soldiers inthe ranks of staff sergeant and above not serving on an NCO Career Status Program reenlistment contract and meeting the criteria below in accordance with AR 623–3 and DA Pam 623–3 are not qualified for reenlistment. Waiv- ers will be submitted through the brigade command level or the first O–6 in the chain of command to Commander, HRC (AHRC–EPR), in accordance with HRC guidance. This includes NCO Evaluation Reports (NCOER) and/or Service School Academic Evaluation Reports covering periods of service after the Soldier’s most recent date of promotion or reenlistment, whichever occurs later.
(a) Soldiers who receive DA Form 2166–8 (NCO Evaluation Report) for the reason of “Relief for Cause” (code 05)."

Further the NCO would likely face the QMP process regardless. Nothing wrong with trying, the NCO just needs to be prepared for the possibility of QMP.

Depends on at what rank they received the RFC at and what rank they are now

Normally a RFC, is a bar and disqualify s anyone from re-enlistment, etc.

You may wish to look for a reserve or NG opening in your field, just in case.
