Can a promotion (waiver) be denied by the gaining unit if the previous commander signed it after the effective date?

Yes.
Your current unit of assignment is the one that has authority for advancements. If the previous company commander did not follow through until after you were reassigned, then it is up to the gaining unit.

My advice is to go to the AG office and ask the experts. If your arguement is supported by them be sure to get the regulation information including paragraph and line.
