Can anyone legally confiscate your Common Access Card?

I've always been told that you should ALWAYS have your CAC on you. Can anyone Civilian or Military confiscate your ID (I'm sure MP's have an exception....I could be wrong)

AFAIK only time a CAC may be confiscated is if it is expired and by an MP or gate guard only.

Why would Joe on the street whos a civilian, have the right, to take your CAC card. Who is he?

If a civilian tried to take my ID I would inform him/her that it is federal property and that I would do everything within my power to see that he/she would be charged with theft of federal property.

No, your CAC is the property of the US government (DOD). Only authorized members of the military may take it away from you. That would include military law enforcement.

If it is expired and you try to enter military installation and the gate guard identifies it is expired they are supposed to confiscate it, but aside from that it's a sensitive items signed you and no one is allowed to take it from you. For example if your restaurant and they offer military discount they say I need to see your ID to show it to my manager the manager should come to you.

As a police officer, the only reason I would ask for someone's CAC card would be if it was the only type of ID they had available to show me. I could use the information from it to locate a DL in NCIC. The only ID I'm allowed to seize from someone is a DL that is suspended or revoked, but not a CAC card.

Is there a confiscation policy that I can reference to? A gate guard stated that the rank on my cac was invalid when asked for my pay grade and said they would confiscate it if I don’t update it soon. Nothing else was wrong. All prints were legible and scan fine. Not expired. Can they legally do that?
