Can I be demoted for relief if the position is a grade higher than I hold?

Long story short, I was promoted into a unit to be a squad leader and 3 months later the section sergeant was promoted out. They put me in the position because out of 18 on the MTOE we had 4 including me and the CPT. So with no guidance I've been trying to figure out what the leadership wants and have been told that I'm jacked almost every day. The talking behind the back is done at full volume within earshot of relieving me and the CSM has let me know that if I keep on missing the mark he is going to start paperwork. My question is can they both kick me out of the section sergeant position and demote me at the same time? I haven't been able to see anything in the regulations either way.

That CSM needs to hear from anyone of a higher rank that you didn't get the training nor have you been given the guidance for the position. If no one is willing to do that than you need to request to speak to him yourself (closed door). If you haven't gotten the support you need and he is unwilling to do anything to ease the burden, you need to talk to JAG. I was lower ranked than you and placed in a E-7 position, there is protocols that have not been followed.

Have you received formal written counselings? As the CPL said, talk to your 1SG and CSM. Nothing works, then request a transfer…

Demote you to E5? That is not an easy process and I would contact JAG, they are here for you.

Has your 1sg given you any type of professional development counseling? He should at least provide you with a counseling outlining what is expected of you and if you are not preforming up to standards he should attempt to correct the issue. What exactly is the CSM referring to when he says you miss the mark?

I'd have to check, but I don't believe it's that easy to demote you without you screwing up really bad. As for removing you from position, yea that they can easily do. Did you ever get counselled by your Rater and Senior Rater to know/understand what the position requires and their expectations?

In my 2 nd tour after 82 abn. Wanted to school lioked over recruits sholder saw a soldier with a camera. Said thats me ,of course thinking how good ir would be to be at the playboy's. Manchin taking pic.RIGHT that never happened. Bu the school and deployment was sweet.
