Last annual closed out almost 3 months prior PCS. Within, I have school for two weeks (non-1059 course) and a 25 days PCS leave. It there anywhere I can look and said the gaining command can not cover the period prior to the reporting date, even there are non-rated codes for it?

Your losing unit should have picked up the final three months as all non-rated time codes I and S, as an extended annual, unless you did not know about this PCS until less than three months out.
Losing unit can't do anything about it now, because an NCOER requires at least three months of rated time, and you don't have that there, so now the gaining unit will have to pick it up as nonrated time code I: In transit between duty stations, including leave, permissive TDY, and TD, on your next NCOER.

So is there a memorandum requirement need for the submission of my current NCOER to stating the reason why it was not being cover the non-rated time on the NCOER?

You do not need a memorandum to explain, they will know a PCS occurred based upon the code that will be utilized for the non-rated time. Make sure to discuss with your gaining unit to give you an extended annual NCOER for your first evaluation with them, this will allow you to have 12 months of rated time with them for the first evaluation with them. Loosing unit should have given you an extended annual. Also could have imputed a non-rated code indicting for the reason. No way your new unit can rate you for those three months as they had not observed your performance. If it’s already submitted to HQ I’m not sure if there’s anything you can do but deal with your unrated time, not a terribly good look. If not, I’d have them fix it.
