If a soldier is facing a Chapter 13 for APFT failure, is there a regulation that states “Soldier can take another Record APFT as many times as he wants until pass, as long as it’s before the Chapter is complete”, or anything like that? Back story is I hurt my knee, I have documentation and everything from past profiles for it, I failed my last APFT and 1sg recommended initiation for chapter. We are deploying soon, I want to know if I can still retake an APFT and pass, and if my chapter will be dismissed. I need an AR backing this up if any?

First of all, if this is your first APFT failure, you will get flagged, but other than counseling, you shouldn't be processed for discharge unless there are other compounding issues besides the APFT. You are require to take a diagnostic APFT every 30 days and you have to pass the Record APFT within a 90 day period. If you fail the second one, you get processed for discharge. So the answer to you question is no, you can't take the Record test as many times as you want. You can take a diagnostic test every day if you could find someone to administer it and will be required to take one every 30 days, but you can't count it as a Record test.
What you should be looking at is getting in shape to Ace the first Diagnostic test, wait a couple of days to recover, then take the record test.

SFC Brian Johnston - Correct, although it's was the SOP everywhere I ever served. However, I disagree on it's bad practice. It's the only tool the commander has to gauge the readiness of his soldiers. If the soldier aces it after 30 days, schedule a record test and get that troop off their Flag. If they don't, it at least gives you an idea of how far they need to go. I absolutely agree that we train APFT badly, at least outside of Combat Arms, and there are a lot of factors involved in getting fit, I struggled with it when I first went in too. I don't think insulating the soldier from failing realistic standards is a good policy, we shouldn't pass out ribbons for participation.

AR 350-1 states “a soldier who fails to meet the minimum required score in any event will be flagged iaw 600-8-2 and be placed in the units special emphasis PT program. The solider will be administered a record apft no earlier than 90 days. Failure to meet the minimum passing score in any event will result in separation proceedings to begin”
