In my opinion she is 100% guilty it doesn't matter if you are a brand new private or the president, classified is classified and you do not mix it in nipr systems. The government should be making a example to all not showing the world rules exist for a few not all.

The real problem is that elected positions are just given clearances rather than *requiring* them to qualify for a clearance first.

The punishments lower enlisted Joe would get for this crime is what she should get.

Yes, We are still a country of Due Process. No matter your Opinion there are certain Legal Benchmarks that need to be achieved to charge someone with a crime and this failed Miserably. No matter what the Intent it came off looking like Republican Kabuki Theatre.

NO. But now they have opened the door anyone who was convicted or has been terminated for "mishandling" classified information. They should overturn their convictions, give them back pay, etc.

As the Secretary of State under EO 13526 she has Original Classification Authority. Can she just not say all the stuff on my personal server is unclassified? So if the FBI was favoring prosecution and she went this route other than the release of truly classified information what would be the next course of action?
How much does the punishment change from storing and conducting official CLASSIFIED business on a personal server to storing and conducting official business on a personal server? Of her equipment how much of it was actually NSA "certified" or equipment that the NSA uses? I do not know all the ins and outs of this story but the only difference I see between PFC Manning is the intended release of information.
I think it highlights the perception that higher rank punishment often is null compared to that of the workers. Reminds me of how a LTC stored two SIPR computers in a key locked desk drawer which was not in a SCIF just a normal office for an entire year deployment (well it was discovered 6 months in) with no punishment, but when that SGT forgot to spin the dial on a SAFE that was actually in a SCIF HOLY CRAP Chapter him OUT!!!!!

Let's me rephrase your question a bit. If PVT Private RallyPoint Member had processed classified information on an unclassified system, what would happen to him. It has been shown HRC did in fact have classified material on her private server.

First, we don't have access to all the evidence... we have tons of rumors and "leaks" and speculation.. everything except the facts. Knowing we don't know everything, we should understand that our opinions are just that, opinions. That said, my opinion is that there are two sets of rules now in effect... there is one set of rules for us common people and another for those who have power.

None of the poll options are anywhere close to my position. My vote would be... We can't know for sure, however it appears that those with power are afforded special treatment.

Having been in law enforcement for 30+ years and most of that time was in investigations, I have investigated and filed thousands of criminal cases. After hearing the press conference this morning, I was sure that charges would have been filed. The FBI laid out a great case against her. I was shocked when he announced that the FBI would not recommend filing charges. Clearly, the FBI was influenced from the outside.

The easy solution would have been to file charges on the failure to protect classified material, offer Clinton a deal to plead guilty on a misdemeanor, and be sentenced to probation only. Or worst case, file the charges and let a jury decide. I have seen many folks prosecuted on far less evidence then the FBI had on Clinton.

While in the Navy Times we read today of an PO3 who transferred classified information onto his personal USB, intent unknown. He got probation, a $7,500 fine, and of course will never hold a security clearance again.....

Responded in another post relating to question. Our problem is that we are all military and have the DOD concept of handling classified information. That concept is different in DOS, which is different in DOJ, Which is different in NSA, Which is different in DOC, etc., etc. There is not a standardized description on how to handle classified information by agencies. Heck, there isn't even agreement between agencies on what should and should not be classified! Military has pretty clear guidelines on classified information thus can take action when those guidelines aren't followed but those guidelines become muddy in other government agencies.
