Do Civilian Contractors, Military, & Government Employees have Cause for a Class Action Suit Against the Government?

RP Members how many individuals do you know have lost their security clearances and were subsequently punished or discharged for their mishandling of Classified materials.

So, if Hillary is not similarly treated, or prosecuted given the magnitude of her actions, could a Class Action suit be filed against the government for denying them equal protection! What do you think RP Members?

I imagine that some civilian contractors have sufficient cause for a Class Action Suit against the Government COL Mikel J. Burroughs. I don't think that Hillary Rodham Clinton has sufficient cause even if she trues to invoke the royal we.
I hope that justice will be fully applied to the cases of Hillary Rodham Clinton before the end of this summer.

Why just limit the question to contractors? Military and Government employees also have been discharged or fired because of the same issue.

Equal and fair treatment of all classes rarely happens. Look at within our own military (past and present) and how an equal offense is provided unequal punishment based on rank.

So far at least it has not been proven that HC committed any crime. Not knowing the full inside story all we can do is wait and let the system work. Remembering Whitewater in which the entire power of a special prosecutor couldn't dig up any prosecutable proof against her, to present day Benghazi where she is accused by some of masterminding the Benghazi incident, she has made her enemies, both personal and political look like ham-hocks. It would seem if 'they' could prove one charge against her that would have been enough to move forward with an indictment. Now 'they' apparently have all the emails, maybe 'they' will have better luck. Here is a link which HC haters might enjoy reading.

The FBI said it was still investigating, so I have reason to believe they should be building a case that will likely fall in her lap in pretty short order. I had hoped the Justice Dept would do something, but I suppose any hope that they weren't a partisan enterprise died long ago.

Sir until the court system has had the chance to do it's thing, I'm going to reserve judgment on her. As far as others go, yes I've seen folks beat down (not physically), for security lapses that were MUCH less than what we have here, but that's the same thing as GEN Patreus. He got to retire with everything, whereas a JE,NCO, or JO would've been lucky to have pants when they get done being hammered for their mistake, and everything is taken away.

Equal protection, 14th Amendment only applies when the states are acting in different ways to a citizen. Dredd Scott as an example. The situation with HRC is the federal government selectively prosecuting which the DOJ is allowed to do. It is not an equal protection issue and the Court will dismiss

I would say yes. Based on the facts we have now and that is that she had a private server and it has been proven to have had classified information on it. If she is not prosecuted then it should be open season on a class action lawsuit.

All I have to say is look at the emails of the kids who sent top secret information to Wikipedia. He was wrong for what he did. He got punished for that and is in jail for at least twenty years. That courts had to be proven guilty by a military court. I say let this go to court and let them pass judgment.

COL Mikel J. Burroughs - Mikel; It's "well established law" that the failure of the state to prosecute one scofflaw is NOT a defense for other scofflaws who commit the same offence that the non-prosecuted scofflaw committed.

Sorry, no class action lawsuit and any lawyer who tells you that you have a reasonable chance of success needs to have their head candled (preferably using the light cast by their burning law degree).

8 U.S. Code § 798 and EO 13526 provide AMPLE room for a successful defence since they impose requirements for the Prosecution to prove things that it simply cannot prove.

Yes a class action can be filed however you need to find an attorney with a big enough pair to do it. It has already been established she broke the laws pertaining to classified material. She states that she was not aware of anything classified earlier, yet she has authority to classify items, which makes her either Stupid or a Liar, either way voting this asshat into the Oval office disrespects all who came before her. If she is not prosecuted for her treasonous crimes then a president has been set, then nobody should be prosecuted. If you are unsure of the use of treason then look it up, when you knowingly violate the trust of those who have given you that trust.

I think it would be classified as unequal treatment under the law. They should have a case.
