I am currently in the USAR and had a baby in February of this year. I'm being told that the revisions of the postpartum policy included in AD 2022-06 do not apply to me due to my birth event occuring prior to the date the AD was approved. I'm mainly focusing on the excused UTAs allowed by the directive. Do I rock the boat or do the revisions truly not apply to me? I haven't taken this higher than unit level, hoping this is a misunderstanding.

None of the changes would apply retroactively, but the changes going forward would absolutely apply.

For example, regarding the excused UTAs, they apply for the next six UTAs, so that would have been March/April .. you don't get them now. However the excusal from events >1 day is for 365 from birth - anything where you'd be away from your home for more than one day is excused (i.e., traditional AT, but if they had you doing AT at your armory where you'd return home every day, that would be allowed).

This sounds like an education issue with your personnel section. Talk with the commander before taking it higher than that, but it's very likely you're the first situation they have encountered and don't have the right guidance.

So the 12 paid UTAs are the same/taking place of the 81 day maternity leave (for reserve) that the previous policy stated?

Previous policy is rescinded - For a normal birth --
- You'll get 6 unpaid UTAs following birth
- In the following 12 month from birth, you will get 12 paid UTAs (yes, these can be used instead of the unpaid UTAs following birth or used elsewhere) in addition to another 4 unpaid UTAs.

Remember - a UTA is not "a day" .. it's is a training period. Your normal weekend drill is a MUTA-4 (Multiple UTA), so if you used all 12 'back-to-back', that could be three MUTA-4s in a row (i.e., AUG/SEP/OCT).

So, if you stretched it out, you would get 6 unpaid UTAs following birth, 12 paid UTAs for parental leave, and an addition 4 unpaid UTAs of parental leave.

10 Unpaid UTAs and 12 paid UTAs with (assuming you have all MUTA-4s) is 5 months and 1 day (MUTA-2) of your 6 month drill following birth.

Again, you won't get the 6 UTAs retroactively that would have occurred back in February/March (or March/April if you gave birth after your February drill), but you will have the 12 paid UTAs and an additional 4 unpaid UTAs you should be able to use before February of 2023.

Understood! I had no issues with the unpaid excused UTAs following the birth.

I was denied my request for this coming Oct (MUTA 4) and Nov (MUTA 4) while I was at Aug BA earlier this month. I'm sorry if I am confused or typing this in a way that is confusing. I hope that clears things up. I truly appreciate you taking the time to write everything out!
