Which means even a conviction on a lesser charge would be wrong. Plus, the Prosecution has gone completely off the rails, multiple times. I know court is not a popularity contest, but juries DO interpret evidence based on how they perceive the lawyers. It shouldn&#39;t be true, but it is. The prosecution has got to be one of the least likeable teams ever to set foot in court. That CANNOT possibly help their case. Like the rioters themselves, no he really shouldn&#39;t have, BUT that&#39;s not the same as having any less &quot;right&quot; to be there than anyone else. People forget there&#39;s a difference between what they should do vs what they can do. Being there wasn&#39;t his job, wasn&#39;t his businesses, wasn&#39;t his town. Nonetheless, being there does not negate his right to defend himself.<br /><br />Was he in violation of state law carrying his weapon at his age? Probably, but if so, violating the law by merely being in possession of a gun does not itself negate a person&#39;s right to defend themselves; and it&#39;s a moot point anyway as that misdemeanor weapons charge was dismissed.<br /><br />Is just having the gun a &quot;provocation&quot;?
