You will learn as you continue in the military that more weight is put on to have paperwork as you continue up the ranks and after. As a NCO, I carried a Leadersbook, as most do. I had everything within that folder not just for me but for my troops. It made getting things done from discipline to awards so much easier. Rather than scrambling to come up with bullets for their awards, I had it and thankfully due to the mentorship of senior NCOs who showed me how powerful a good Leadersbook could be I have carried that into civilian life. Today, I maintain a &quot;LifeBook&quot;. Inside I keep things like my current lease, to my dog&#39;s paper work, children&#39;s report cards, military paperwork and other things that I find I&#39;m asked for. <br /><br />Whenever you are thinking of going down this road, you&#39;ll need that level of documentation because the last thing you want is to move forward without the proper background work which will result in setting yourself up for failure. By requesting redress the wronged member of the military is asking that the “problem” be addressed and fixed. Army Regulations [1] define a “wrong” as:<br /><br />A discretionary act or omission by a commanding officer, under color of Federal military authority, that adversely affects the complainant personally and that is-<br /><br />(1) In violation of law or regulation;<br />(2) Beyond the legitimate authority of that commanding officer;<br />(3) Arbitrary, capricious, or an abuse of discretion; or<br />(4) Materially unfair.<br />If the problem is not addressed and fixed by the commanding officer, a formal complaint (Article 138) can be made to a superior officer (higher in rank to the officer who is responsible for the problem). This will trigger an investigation into the problem by the court-martial convening authority over the commanding officer against which you brought the initial complaint. The investigator should, “examine the complaint and take proper measures for redressing the wrong complained of” [2] and should report their findings to the Secretary of the Army (or Navy, Air Force etc). Any retribution or reprisals for filing an Article 138 can be the basis for additional complaints.<br /><br />Before you file an Article 138 Complaint:<br /><br />The actual filing of an Article 138 complaint will go on the officer’s official military record and thus the actual filing is not something to be taken lightly. Even before you request redress, which always comes before you file an Article 138 complaint, consider orally conveying to your chain of command that you are contemplating submitting an appeal for redress in pursuit of an Article 138 complaint. One option for this is to use the open door policy to meet with your commanding officer. In a polite and formal tone you could suggest something similar to the following:<br /><br />Sir/ma’am, I have been trying to resolve __________ and I know I’m being harmed by __________, and I am thinking of filing an Article 138. It was the right thing to do, and it fixed the problems that needed fixing. <br /><br />However after that was accomplished, the officer who initiated the Article 138 decided that their best personal option was leaving active duty for the Reserves.* The senior officers of that community didn&#39;t appreciate having the UCMJ applied as a tool to help them update their policies. The chain-of-command climate had been permanently poisoned by the environment that caused the 138 in the first place, and all of officer&#39;s personal &amp; professional bridges of reconciliation had been reduced to smoldering rubble.<br /><br />In general, when you file an Article then 138 the military has a chance to improve their processes and policies. However if you have to file a 138 to accomplish that then everyone loses. As Col Lenertz stated I informed the chain of command up to the Group level. The Group Commander took care of it from there It was against my Squadron Commander. I was lucky enough that my flight to AIT was the same flight that the former commander of 3/69 armor was on. 3/69 was yhe spearhead into Baghdad airport. I successfully used Art. 138 for something that was obviously illegal and immoral. There is a very very specific procedure that must be followed. I would highly suggest you have dates, times, etc. that support your grievances prior to utilizing this resource. After requesting redress (remember that you have to give the command a reasonable amount of time to fix the situation), if the matter is not resolved to your satisfaction you can choose to go past your commander to the next person on the chain and it will continue to go all the way up the chain until it hits the desk of the Secretary of the Army (in reality, one of his many peons). You will receive a letter from that person sometime later to see how they weighed in on your complaint. Once you decide to go past the lowest level and further the complaint up the chain you cannot stop the process. It will go all the way up whether the matter gets resolved to your satisfaction or not. I caution you not to take this road lightly. My case was valid and involved high ranking officers covering a crime that affected innocent military spouses who were contractors. I will say though that despite my redress being granted after many months of IG investigations that went all the way to the DOD IG it was still swept under the carpet. The senior officer most responsible was simply given a written reprimand which I found out through a FOIA request. He was later promoted to O6 so clearly that reprimand did not have a big affect on his career. Don&#39;t file an article 138 for something petty and try other avenues first like IG. Filing an IG complaint is the way to go. However, the IG is not a panacea. All parties are investigated as part of an IG complaint. The investigation can result in charges against the person filing the complaint. Finally, remember that the IG is in place to support the command. About 90% of IG complaints end in favor of the command. Do what you think is correct, but be mindful these factors. Unless this grievance is a multiple time offense and you are not the only soldier involved I&#39;d recommend taking a different approach to resolve the issue. You can forget about your unit JAG office because they will tell you &quot;I work for the best interest of the Commander&quot; so they are useless. That&#39;s the other thing, the Commander has a JAG office all to themselves who can work on his defense ALL DAY LONG, you don&#39;t have that. All u have is Trial Defense Services and that&#39;s probably a CPT or LT that doesn&#39;t have a lot of experience. IG is a good approach but, after they investigate, the Command is going to know immediately why and who it&#39;s coming from. 15-6 investigations need some serious revisions as well. I say this because most of the time, the investigating officer is a new guy that still has to prove themselves to the Command. They are picked that way on purpose because the investigating officers recommendations could and will have an impact on the career path the Commander chooses for the individual AFTER the 15-6 is complete. I&#39;ve personally witnessed a Brigade Commander O6, have a 15-6 packet returned 3 times to an investigating officers because he didn&#39;t have certain verbage in the investigation so the Commander could read an article 15 to the Soldier being investigated. Granted the investigating officers can go to IG as well BUT as mentioned before, his career will take a nose dive once the investigation is complete. The other problem with IG, is they want to have sworn statements...Good luck trying to find anyone with rank that will put their name on a piece of paper acknowledging that the Commander was wrong. They have their careers to worry about too. This course of action you are considering will work if you have all your ducks in a row, IN A TIGHT ROW but, you will probably be all alone. Don&#39;t look for too much support from people in your unit, IG and a lawyer will be your best bet. Fiscus, JAG- USAF, on Article 92, unprofessional relationships (10 years), conduct unbecoming and officer, fraternization and obstruction of justice. <br /> Punishment-Article 15, reduced to colonel and received a reprimand, drawing full retirement pay.<br />SSgt. Jones, Unprofessional relationship, (two months), violating a no-contact order.<br />Punishment-Special Court Martial, reduced to Senior Airman, received a reprimand and fined $1,000.<br />What say the scales of Justice? Client confidentiality (and common sense) prevent from detailing it here. Similarly, I am not going to provide legal advice. The COL ultimately prevailed, but it was a long ugly process. The convening authority became the CAR shorty thereafter. As for me, although I cannot prove it, I believe it&#39;s a primary reason reason I was passed over for MAJ. I was prior enlisted and so just opted to retire a few years later.<br /><br />In addition to consulting the IG, I make an appointment with legal assistance. There may be other options. If possible, see if you can get a JAG from outside the chain. But the COG Was denied his star that year for the blemish on his record. Even if you were not being charged with something, you can always talk to trial defense service. That is your equivalent of a public defender. Everything you say To that person has legal immunity ( attorney-client privilege). So you can say anything at all to trial counsel and get essentially free legal advice without having account against you. If you talk to the IG or SJA, they represent the commander, not you so they are obligated to speak to the commander about anything that you said. You DO NOT have attorney-client privilege with any of those people. The IG heard me out, and once his name was brought up I was told that my complaints were on record and it wasn&#39;t the only complaint. The NCO was relieved by the end of the day and told to retire. Here is the deal, I am a chain of command guy, but when you can&#39;t use it and you know (beyond of shadow of doubt) that you have to &quot;goods&quot; on someone then go to the IG. I won the battle and lost the war, but was comforted later finding out the SGM was a drunken wife beater and the CO covered it up. He was gone after a year and they pretty much left me alone after that. I can tell you I ended up with a relief for cause and an intimate knowledge of the appeals process. The command does not have to follow regulations in that aspect as the IG told me there is a specific redress for evals. You have no right to be counseled in a timely manner and if you piss off the CO you will have an inflammatory paper trail started against you. Know this: once you hit 17 years, you can come to work and put your feet on the desk just dont get insubordinate. You can&#39;t be kicked out of the Army for alleged incompetence. Some would use that article to harass the CO, of the DB and the CO of Ft. Leavenworth. <br />Fixed that by handing them their DD and BCD&#39;s and then marching them next door to the US Federal Penitentiary to serve the balance of their sentence.
