Does Clinton deserve the same fate as Petraeus?

As the investigation continues, there is more classified information that was in her unclass server. Increasingly to me it seems as though there are more similarities between her and Petraeus. She she be convicted as he was? Or will it die here?

LTC David S. Chang, ChFC®, CLU® - Major; Mine is a "Conditional Yes" because she would have to be convicted of doing the same thing as General Petraeus was convicted of doing.

Considering that Gen. Petraeus pled guilty and Ms. Clinton is not likely to have done so, Ms. Clinton's punishment - upon conviction - should (using the generally accepted rules of sentencing) be more severe than his was.

Clinton's actions were worse than Petraeus' actions. She compromised more classified information in a manner that left it open to foreign governments; Petraeus only put it in a locked drawer of his quarters so that his biographer (who had a security clearance) had access to it for background information.

State Department flags 305 more Clinton e-mails for review ...

A State Department official told a federal judge Monday that 305 more of former secretary of state Hillary Rodham Clinton's e-mail messages have been flagged for further review by intelligence agencies, to see whether they contain classified material that should not be released to the public.

Clinton turned 30,000 e-mails over to the State Department in December 2014, and the department now has a team reviewing the correspondence to determine what should be released and what should be redacted under laws that allow the government to withhold public documents from release on a variety of grounds, including national security.

A federal judge has ordered the State Department to release the cleared documents to the public on a rolling basis, with all of them to be available by January.

MAJ Robert (Bob) Petrarca Sir, if the evidence supports probable cause of a violation of laws of our land, then yes she should be charged without regard to her politics, status, or popularity. Sadly, politics in our Republic have a strangle hold on "the rule of law, not men." All I require is fairness. Lets hope we get fairness and transparency in this investigation.

Classified "spill" is classified "spill". Regardless of the position....in both cases, classified material was mis-handled. If they knock a 4 star general out, she should get the same boot.... I personally feel that she is more evil, so therefore, all the more reason to bust.

I wouldn't even give Clinton the satisfaction of calling her email server UNCLAS. I would call it what it was/is, a PRIVATE server maintained by a company not vetted to handle US Government classified info.

With that said, I believe that she should suffer a fate worse than GEN Petraeus. I believe that between her email server and Benghazi, she belongs in Leavenworth.

(1) If an unfettered investigation is allowed to be collected and the evidence is examined using current forensic techniques and capabilities. (2) That evidence leads to a grand jury or similar process recommendation to proceed to trial, (3) and the appropriate standard of conviction is used [beyond reasonable doubt, reasonable man, etc.] and (4) she is found guilty then she should be punished in accordance with whatever crimes she is convicted of.

First, if anyone in the military did something like this, mishandling classified information, you better bet you would be in some serious hot water. One email here or there that is accidentally sent over the wire to the non-secure network, you might get off with some paperwork if it isn't damaging information. If it happens more than once and it contains national security information, you lose your security clearance and possibly face prosecution by courts martial.

I think her feet should be held to the fire. The notion of not knowing is no excuse, ignorance is no excuse for not knowing the rules for handing of classified information. And...wasn't she an attorney before. Oh that's right, she got fired from a government job when she was an attorney for making false statements. Not a leader in my book.

I hope she is held accountable and prosecuted, revoking her clearance, and given a penalty and prison term per instance...now up to 350.
