As a former Commander, I know that we always consider in Judicial, Nonjudicial and Administrative actions Manners of Extenuation and Mitigation. I suspect do the same in other US systems. As was already stated, I am sure his service record, his service to the nation, and him fixing Iraq, were all taken into account. <br /><br />You are correct, Officers vs. Enlisted are always handled differently, as the rules are different by law. I am not saying agree with this part, but the rules are different. Reducing an officer in rank or removing them from active duty is not the same process, regulation, etc as we use for enlisted Soldiers. Civilian the punishment is a joke.<br /><br />Anyone remember Edward Snowden? He is still on the run for his life, after releasing that the NSA is spying on our phone calls violating the very constitution they swore to protect. <br /><br />Congress was calling for Edward Snowdens death as a traitor, Gen. Patreus got what amounts to a slap on the wrist.<br /><br />What this shows is their is a double standard between normal people like Snowden, and people in power like the General. Any service member who commits adultrey should be promptly stripped of any and all security clearance. They can not be trusted, someone who cheats on their spouse will consistently place their own wants above all the welfare of others. There is a reason it is punishable by up to five years imprisonment under UCMJ.
