SPC Private RallyPoint Member 4188353

So to start off I was in a car accident which caused a shoulder injury as well a whiplash. I ended up going to sick call which they gave me a temporary profile on my sick call slilp which stated “activity at own pace to own pain tolerance” a week after that I was given a PT test. Prior to the test I let my squad leader know that I was on profile, injured and would not be able to preform. I was told I still had to take the test also at no point prior to the test was I given notice that the test was for record. I took the test which I failed push-ups (unsurprisingly) and 3 days after taking the test I got told by my squad leader that I either had to go to the board or that I will be flagged for an APFT failure. I agreed to go to the board however I said I’m going to fight the flag if they try to pursue it. Well they didn’t like that and decided to go ahead with the flag. They still have not issued me the flag or counseled me which I’m assuming is coming tomorrow after they do height and weight (4 days after the APFT). As you can see this is a shit show and I’m trying to figure out if this is in fact a valid APFT along with the flag. If this is not please provide the FULL AR as I’m going to have to fight this uphill battle. How can I determine if my APFT failure and flag were valid? 2018-12-06T19:21:31-05:00 SPC Private RallyPoint Member 4188353

So to start off I was in a car accident which caused a shoulder injury as well a whiplash. If not, usually they last for no more than 30 days. The profile Regulation is found in 40-501, Chapter 7, AR 600-20, AR 600-8-101. The profile is the recovery period. Once the profile expires, then you are eligible for full duty. In reference to the APFT, your profile would had to have been marked for specific limitations. The new profiling system pretty much did away with recovery time. So once your profile is expired that is it. This becomes a bit of a mess, if you are on profile no one should force you to break that profile until it expires. But since this profile did not have a date on it, not sure what the regs say. Then you can still take an APFT for the events that are not listed. Now did you turn the profile into the orderly room? I have cut soldiers slack if they were up front with me from the get go and would reschedule a time for them to take the APFT. Also height and weight doesn't have to be done on the same day as the APFT nor does it have to be in conjunction with an APFT. Now your Squad leader doesn't have the power to say if you go to a board then you will not be flagged plus if you failed the APFT this would come up in the board. Your story has holes in it or it is missing information that is needed for better advise. Since you never mentioned expiration date, I can only guess it was for 14 days. But regardless how many days, you were not supposed to take an APFT test at all due to the fact you were still on profile and you didn't have recovery period that's granted after profile ends. What board is your squad leader referring to??? I wouldn't worry about the flag due to fact you were on profile. If they still want to pursue the flag, then go see JAG or IG to file complaint......... There is the regulation below from you guys PT manual.............

Army TC 3.22.20 Army physical readiness training

14-11 Temporary Profiles

Temporary Profiles
A soldier with a temporary profile must take the regular three-event APFT after the profile has expired. (Soldiers with temporary profiles of more than three months may take an alternate test as determined by the commander with input from health-care personnel.) Once the profile is lifted, the soldier must be given twice the time of the profile (but not more than 90 days) to train for the APFT. For example, if the profile period was 7 days, the soldier has 14 days to train for the APFT after the profile period ends. If a normally scheduled APFT occurs during the profile period, the soldier should be given a mandatory make-up date.
