In this case,
according to AR 635-200, notification of separation is required. Jackson we had an SSG who seemed to always go to medical a day or 2 before APFT and would come in with a temp profile for running or even walking. This went on for 2 years. AR 600-20.
Commander can refer the Soldier back to the MTF, and can hold a personal conversation with the profiling official, for reconstruction of the profile AR 40-501.
Are you notifying the Soldier well in advance of the APFT, and the Soldier then goes in sick call prior to that date and gets another profile? If so, don't give the Soldier advance warning, or give the Soldier a date a month after any permitted recovery period, then, when Soldier shows up for PT the day after any permitted recovery period, pull him out of the formation, and a couple of graders, NCOIC, and OIC. Administer the test. Requirement is to be informed of a record exam prior to the test beginning. As you are reading the instructions, is sufficient notice for a record exam. Don't let anyone else know of the plan. If the Soldier is a poor performer then document everything clearly, concisely and without "ANY" appearance of malice. I feel your pain been there and done that. But if a troop truly is a detriment to a unit you have to build your case like the foundation of a building. When I first heard the term "Everything in writing or it didn't happen" I said YEAH, YEAH, BLAH, BLAH. After my first attempt at removing a malignant tumor in Cami's I asked for peer help and advice in my unit as well as my 1SG and CSM. A Soldier that cant not pass an APFT gets flagged, no favorable actions, no promotions no plum assignments. While waiting for his/her profile to expire and the Troop regain physical fitness, assorted assignments that comply with the profile and that allow them to contribute to the mission like everyone else. I used to include my profile SOLDIERS in "ALL" activities and locations and time periods withing the limits of the profile. I had a man (I hesitate to give him the honor of calling him Soldier), that did this repeatedly. All it took was calling him in, having the CO read him his rights and then counseling him for suspicion of Malingering. Whether or not reading him his rights was the right thing to do, it scared the pogies out of him and he tightened up his shot group for a while. Eventually he was chaptered for what should be in the regulations as a "Pattern of Stupidity" Response by SSG Roger Ayscue made Jul 17 at 2020 1:59 AM 2020-07-17T01:59:36-04:00 2020-07-17T01:59:36-04:00 2019-02-19T03:34:31-05:00
