I have a peer who is an early commission graduate from a military institute. Is he not rated until he completes his degree & BOLC?

If he's been commissioned into the IRR while awaiting completion of his degree requirements that is in deed correct.

Until he gets assigned to a unit reserve or active how can he get rated? Therefore his first evaluation even if it's as a 1LT due only to time in grade will come from the school house then an OER.

IRR meaning individual ready reserve not individual retired reserve of course.

This is too vague. What component is he? Rated? You mean with an OER or an academic evaluation? Is he an SMP serving in an officer's billet in a drilling unit? Is he on an educational delay?

To answer previous questions, SM is a drilling Army Reservist, and the question is if he is to be rated on an OER or not.

The Army Reserves appears to differ from both Active and NG. Following up on LTC Mackay's information: per AR 623-33-34 B. (5) (d), not being rated before BOLC does not apply to Reserve TPU Soldiers. This is explained further in Annex G-5 (m):

m. Newly commissioned officers or newly appointed warrant officers who have not yet completed their respective officer basic course (BOLC or WOBC) and are assigned or attached to a TPU or reinforcement training unit are entitled to receive mandatory and optional OERs as detailed in chapter 3. In order to receive an OER, the rated officer must have been assigned under a rater for a minimum of 120 days (or 90 days for USAR Soldiers on ADT or ADOS–RC tours). The senior rater will enter a comment in the OER, part VI, block c, indicating that the officer has not yet completed the basic course as of the “THRU” date of the report. The “FROM” date on the rated officer’s first OER will be his or her commissioning date.

Which would still say that he should be being rated. I have been instructed by our BN S1 not to rate him because he hasn't completed his degree. I still have not seen anything supporting this statement. I am attempting to ensure this LT's career isn't being slowed or weakened by someone's incorrect understanding of policy.
