Failure of NCOPDS will result in a BAR for first failure. The BAR will be reviewed every 90 days, after the second review if the SM has not over come the BAR, in this case, graduate the school, then chapter paperwork will be initiated. Don't remember which chapter it is, but failure to overcome a BAR is one of the easiest chapters there is.

Well, I will begin this response by saying that I would recommend some serious remedial training for everyone from the team leader to the 1SG for sending a Solider to NCOES that they knew was not within prescribed standards, but that is neither here nor there. Moving on, chapter 18 states - to paraphrase - that Soldiers will not be chaptered under chapter 18 when the Soldier meets the requirements for chapter under another provision of AR 635-200. So, the way I see it, the Soldier would be chaptered under Chapter 19. The reason is that the Chapter 19, para 19(7)c specifically discusses NCOES as an element of the provisions of this chapter. Paragraph 19(7)e also mentions any discriminator that leads to a commander's BAR to reenlistment -which by the way, should be used as a rehabilitation tool, not a punishment - as grounds for separation under chapter 19. The conditions that meet the letter of the law, so to speak, of this sub-paragraph include failure to maintain standards outlined in 600-9 for body composition as well as PT failures. 19–7. Selection criteria
QMP selection criteria include, but are not limited to—
a. Moral or ethical conduct incompatible with the values of the NCO corps and the Army ethic.
b. Lack of potential to perform NCO duties in current grade.
c. Decline in efficiency and performance over a continuing period, as reflected by noncommissioned officer evaluation report or failure of Noncommissioned Officer Education System (NCOES) courses.
d. Recent or continuing disciplinary problems, as evidenced by conviction by court-martial, nonjudicial punishment, or administrative reprimand.
e. Other discriminators such as imposition of a field commander’s bar to re-enlistment, inability to meet physical fitness standards, and failure to comply with requirements of the Army body composition program.
