The General Officer investigating this case is entitled to his OPINION regarding this case. That is why we have due process (even in military cases). The General's opinion will be among many that the Article 32 panel will hear in rendering its decision (as a grand jury) to the Commanding General (and Court Marshal Authority) in this case. I still have faith that 'the right thing' will be done regarding this case. And...that is the great thing about our country...even an unpopular person like Bergdahl who allegedly abandoned his post, gets an Article 32 (Grand Jury) hearing and (if probable cause exists, which it probably does), a trial instead of a bullet in his head. A silly little thing called the Constitution is one of the reasons we serve (and last I knew we swore to protect and defend it). So let the investigating officer say what he will. The process will work in the end (and if it does not, I guess Congress will need to do something about the way UCMJ is administered so justice is served next time...I'm OK with that, it is part of the protection WE ALL HAVE! And anything different would be really scary!)
