Is it a breach of contract to not receive my re-enlistment bonus after approximately 2 years of being MOSQ?

Re-enlisted with a bonus. Became MOSQ and failed to receive the bonus after 90 days per the contract. It’s now going on 2 years and still haven’t received it-I have not been flagged for any reason. My Command has been advised of the situation multiple times. IG notified . Would this constitute a breach of contract and I can walk away from the 6 year obligation?

Walking away from a six year contact is not always the best thing to a temporary problem. Hetting the bonus your entitled to per contract. Thats another problem... had that issue too supposed to get 1/2 in front and 1/2 on completion of contract. Paperwork i had to get my S1 shop to fix it.

The national Guard has had a structural system problem that lasted over a year. There is a backlog and issues getting the bonuses processed. There are a few ARNG CSMs on here that can advise as they are painfully familiar. Is your contract breached. No. Continue going to drill.

Add ARNG and reenlistment bonus as tags

Do not walk away from your obligation! Get a copy (never originals) and have a serious conversation with your unit’s leadership; and your S1. Perhaps you might have them to tackle the the S1 directly. Now, are you Reserve or NG? If the 1st, congressional representative might positively influence the situation. NG, my knowledge is zero on it.

SGT K Sim, Never just walk away from your enlistment, it could be considered as dereliction of duty and or desertion. My advice if you have notified your Command, S1 and IG, I would get JAG involved to see what your legal options are. Just my opinion.

Don't walk away. You can't fight city hall, whether it is in the military or anywhere else. Find the right outlet to channel your concerns to. Respectfully and honorably write your Congressperson, and also most respectfully inform your command that you are. This gives them all a chance to fix it. This sounds like a typically military faux pas. It fell through the cracks, as things always do, especially in large organizations.

Nope, it is not. First, look at your contract and make sure that 1) The bonus is reflected there on the signed contract and 2) what the stipulations are of that bonus in the contract. Once you have done both these, and verified you are entitled, get with your leadership. Sometimes it is just a paperwork SNAFU and can be easily worked out. Yes, the ARMY will back back you the entirety of what you are owed, if you are owed it. Keep on your command about it. I see by your profile you are National Guard, so you will need to write to the governor of your state and any representatives there in the state.

You need to contact the Army board.of corrections of Military pay and records. It is a.process where you submit your evidence and it is resolved in a professional manner. It takes about 6 months or did back in my day. 1976 to 1996
