As such, it could be tried under Article 134 or Article 92 (failure to obey a lawful order or regulation). You'd be hard-pressed on the books to have them not be in the chain of command in that environment. As mentioned, there are fornication and adultery articles as well (sodomy, unnatural carnal acts, et cetera). There are also criminal potential of sexual assault/sexual harassment, especially if the CAPT is a signatory on his evaluations (undue preferential treatment). Food for thought. We were both in the same command. We were both division officers in the communications department. She had zero to do with my fitreps and no authority over my division.
