Since you had until 2400 to report and you returned to military control less than 24 hours later, you are not AWOL and you pay check won’t be stopped for “bad time” since you must be absent for at least 24 hours for that to occur. Technically, you failed to repair on what is traditionally a non duty day. Your command could charge you with the FTR but I have rarely seen anything other than an admin adjustment for less than one day. By regulation you were AWOL for 1 day. They can hit you with an ART15 if they desire. NOrmally Post One Stops, don't want to worry with UCMJ. You get paid 24/7. Period.
However, as your leave ended on the 9th, that means that you had to be signed into whatever your unit was by the time listed or you can and possibly would be considered AWOL. If it says 2400 on the 9th then it means exactly that. It means that your ass better be at your unit and signing off leave at the CQ prior to 2400 on the 9th.
CoC DOES look at that and they will be on you about it. The punishment can range on just what kind of 1st Sergeant you have and what kind of example they want to set. You could get off with a simple counseling statement followed by some "voluntold" assignments to a summarized Article 15 to a court martial.
Most likely though they will charge you for the extra day, counsel you and let it go at that. Who published Promotion orders, MOS, and PCS orders. It is my understanding you would need to extend for one day to ‘cover’ you for the 10th day. You could also check into your unit on the 9th to avoid paperwork. However your PSC leave ends on the 9th.If you don’t check into your new before midnight and you don’t extend, you could be considered AWOL. I would talk to someone but in Personnel Management in your new unit for a clear answer. You could also search the Army Regulations regarding PCS. If your orders end your leave on the 9 th, then you need to report to your new place not prior to midnight. I would still refer you to the Army Regulations, sorry I don’t remember which Reg covers PCS leave. I would check with n on the 9th to eliminate extension paperwork or the possibility of being AWOL. When reenlisting you are paid straight through, if you reenlist for current or another station your pay doesn't stop and that includes between services. Just he sure to report in on time. However, once you sign in on the 10th, that day is considered a duty fay and you will not be charged leave for that one day. Does it make sense? Maybe not, but it is just the way it works. Now...how was your leave approved till the 9th is another story...the MPD should have caught that and make you redo the LV form to carry you all the way till report date. Ohh well too late I guess...the extensionnis the right thing to do I this case. 1SG Private RallyPoint Member Sun, 11 Aug 2019 14:01:38 -0400 2019-08-11T14:01:38-04:00 2019-08-10T20:05:34-04:00
