Yes, communications on such a device are covered but as pointed out by others here not all information is covered by such laws. But it doesn't matter which device you use you can't get out of FOIA simply by using your own device. The device isn't so important as is the nature of the communication.

If he has a government email account and conducts all official business on that account which is properly archived he can safely destroy that device when he is done with it.
