Is there anything that I can do for being wrongfully placed In the Reserves? https://www.rallypoint.com/answers/is-there-anything-that-i-can-do-for-being-wrongfully-placed-in-the-reserves

I joined the U.S. Army reserves in December of 2015. It has always been in my best interest and career goal to make the U.S. Army a full-time profession, but I was told at MEPS that my high school diploma was a tier 2. Which I guess is equivalent to a GED. At the time I was struggling in the civilian world and I figured that joining the Reserves would at least help get my foot In the door. The recruiter that I was working with at the time also told me that I could make the switch easily. That was definitely misleading. Over the course of 2 1/2 years, I have been trying to go Active. I have turned in two DD Form 368's, but the first one had stalled out in battalion for a year and expired. I turned in another conditional release in October of 2017, and It is at the final approval stage. BUT I am hearing from my UA that most of them are being denied. Recently I had gone to an Air Force recruiter and he then evaluated my diploma and showed me that it is indeed a tier 1, and was wrongfully placed in the Reserves. I also went to two of the local Army recruiting offices and got a call back from one of the recruiters who also told me that my diploma showed as a Tier 1, not a Tier 2. On top of that, I have recently got in contact with a friend who graduated from the same high school as me, and joined 2 months before I did, and he was able to join Active. I never dropped out of high school, my high school diploma says "Diploma" on it, and all of the recruiters I've talked to has said that it's pretty shady that the person who evaluated my diploma would count it as a 12J. Since being put in the Reserves, it has caused a huge negative impact on my life. It is hurting me personally because for the past 3 years my life and career goals have been put on hold. I don't want to pursue another line of work, and I don't want to embark on a different career path. Since I just found out about my diploma, I was not able to include that in my justification memo. It has been very challenging as I must deal with a full-time civilian job and it has caused a strain and financial hardship on my life. The last thing I want to do is step on Army toes, but I have worked my Chain Of Command and the issues have gone unresolved or they sit on it. Someone's careless mistake has cost me my life, and withheld me from going active immediately. I know that at this point I will still need to get released from my unit to go Active, but is there anything I can do to expedite it since I am not supposed to be here in the first place? Is there any firepower that I have to get me Active with no problem? It has been extremely stressful knowing that I could have been Active, that 3 years of my life and career has been wasted, my life has not been able to grow and develop properly. It has been an uphill battle trying to go Active and I can't get a fair hearing as far as being allowed to go active. That’s going to be the Army line you hear from a lot of leadership. Could you have asked more questions at MEPS and talked to other recruiters? Maybe...but that won’t help you now.

I’m assuming you signed a standard 6yr TPU / 2yr IRR contract. That doesn’t mean you’re obligated to stay in your assigned unit or MOS. Definitely keep trying to go active if that is your wish, but also look at potentially reclassing or changing units.

Just remember your CoC has ultimate approval authority and unless you can prove someone forced you into a contract under false pretenses, you have to stick it out. Talk to Jag and see if there is anything you can do about having your Deploma listed as a Teir 2. That still shouldn't have stopped you with going Active Duty though. 2. Continue to try and get a conditional release, when is your ETS with the reserves? You can try going into the IRR and then from there go Active. You might ask about that with your Recruiter. Is your unit a RFX unit? If it is you are better off waiting till your ETS date and then go Active Duty.
