That is decidedly what I would do; but here again: I don't know anything about this. PFC Private RallyPoint Member SPC Margaret Higgins Thu, 29 Nov 2018 17:29:45 -0500 2018-11-29T17:29:45-05:00 Response by PFC Private RallyPoint Member made Nov 29 at 2018 5:31 PM https://www.rallypoint.com/answers/medical-wavier-denied-from-meps-is-this-it-or-can-i-fight-it?n=4169565&urlhash=4169565

PFC Private RallyPoint Member Thu, 29 Nov 2018 17:31:33 -0500 2018-11-29T17:31:33-05:00 Response by SSG Private RallyPoint Member made Nov 29 at 2018 6:00 PM https://www.rallypoint.com/answers/medical-wavier-denied-from-meps-is-this-it-or-can-i-fight-it?n=4169641&urlhash=4169641

Well PFC, some things can be waived, while others can't. If it's a serious condition that could potentially put you or others in danger, especially in the state the military is in now, the Army will not accept the burden.... When you get time Google AR 40-501 standard of medical fitness. This is the regulation the MEPS use to determine if you are fit to serve. Look in chapter 1 or 2 for new enlistees and see if your condition is listed there. If it's there, it will tell you what will disqualify you from service....... if it's not listed, then you can fight it...... MEPS denied me a couple times. My recruiter had her ducks in a row and got a waiver for me to go back & was then cleared. It's a long process, man. As yours says, "not waiverable" there's nothing you can do. You can call a congressman who will inquire and they will point out that your condition is non-waiverable and your decision was made in accordance with approved policies and procedures. I was a heavy smoker and meps decided there was something there. They sent me to their specialist to do a lung function test. Well they determined I had COPD and medically disqualified me. I put down the smokes and a few months later went to a civilian doctor. Had theung function test redone and came out clean. Submitted all the paperwork back up through meps and they gave me the green light. So don't always take their word as a final answer. Fought for years to get back in. I had to spend thousands of dollars proving I did not have a respiratory illness that the Army diagnosed me with. I finally re-enlisted in 2016. Took a lot of work, time and money; but I was approved in the end. Your issues seems to be that they are saying you have an illness that is not waiverable, you need to prove you do not have that illness. Best of luck too you PFC! The MEPS Chief Medical Officer can medically disqualify you, but the service branch you are applying for can WAIVE the medical disqualification. In the case of the Army, it is the USAREC Command Surgeon. If you medical waiver was disapproved, then you are pretty much done unless later the condition improves and you can get medical documentation that proves that the current condition is resolved. People will advise you to call your congressman or whatever, but that never works for medical disqualifications. They are going to side with the regulations and the decision of the medical waiver approving authority.
