NCO who makes frequent false statements, but uses reg to point of senior leader fear to pursue disciplinary action. What can be done?

NCO was transferred to our unit, after leaving their place of duty with a serious incident on their watch. Denied all allegations. Since NCO has arrived at new unit they have caused two subordinate soldiers to undergo senior leader punishment after denying knowledge of their where abouts. Has been on an 'extended' detail so any trouble making is far away. However, that does not solve the issue.

Not sure I'm tracking "senior leader fear to pursue disciplinary action". Do you believe the NCO is somehow threatening the leaders so as to prevent them from taking action against the NCO? Sort of a reversed toxic work environment. Need some more meat on the bones to make any sort of helpful suggestion.

What exactly is he doing that falls within regs, but has gotten two subordinates hemmed up? Also when you say false statements do you mean things like "war" stories, or he is lying to people about what he is doing and where he is while on duty?

Please provide an example of what you mean..something this NCO has observed then threatened his leadership with having violated regs or what has not been done that was required by regs.

I'm confused. Did he know of the subordinates whereabouts? Did he get them in trouble out of spite? Is he incompetent? All your statement implies is that he got in trouble In the past and denied knowledge of a subordinates whereabouts. Clarification is needed.

Okay, the term "serious incident" is extremely subjective. People get moved around for numerous reasons. In addition, soldiers are always doing things that deserve punishment. I'm getting a feeling that you may be upset about what is going on, but without real information regarding the conduct and activities it would be impossible for anyone to say whether or not this NCO is doing anything wrong at all.

I concur, this post looks like it came from the S2 shop. Is he lying, are his senior leaders being blackmailed. A serious incident, was he charged/punished? Exactly why were the sm's punished and for what. Is this NCO in their chain of command? You need to learn to be both more concise and precise.

I think hes meaning that the NCO at hand does one thing but says the other and since theres not enough evidence behind it If the leadership does some sort of disciplinary action that it might back fire. Its not really bitching its more like that NCO needs to get knocked down a few ranks cause ive had NCOs that you tell them you got a appointment or some sort of thing to deal with and while at said appointment or whatever it is get a phone call from Platoon SGT and get bitched out on where the hell im at and the NCO(first line ) will deny the fact he forgot and get the joes in trouble that way butttttttttt people( leaders ) think NCOs dont do shady shit then say the other oerson just whininn or something

First, no reg can or should be able to protect anyone from false statements, frequent or otherwise. Leadership is leadership and some people ask to be destroyed so they can be an example of what not to do, so other can learn from their mistakes.
