On the DA 61 for the warrant officer packet, is a moral waiver needed if my case was dismissed at age 12?

I was 12 with a very small criminal case in which was entirely dismissed on the means of myself not being the actual one doing the criminal act. I passed my secret clearance, so I don’t see a point in putting in for a waiver

SPC that's a juvenile record and not applicable especially since it was dismissed. You're good to go.

I don’t think you need a waiver since it was dismissed. However, You need to see JAG or a legal expert to be 100% certain and cover yourself. Good luck!

This is straight from WO Recruiting. I'm assuming you were summoned to court and it was dismissed later on. In any case, it would probably be wise to send in a moral waiver anyways since it does mention juvenile offenses.

"Moral ETP - IAW Block 26 of the DA 61 a Moral ETP is required if you HAVE YOU EVER UNDER EITHER MILITARY OR CIVILIAN LAW BEEN INDICTED OR SUMMONED IN TO COURT AS A DEFENDANT IN A CRIMINAL PROCEEDING (Including any proceedings involving juvenile offenses, article 15, UCMJ, and any court-martial) REGARDLESS OF THE RESULT OF TRIAL, OR CONVICTED, FINED, IMPRISONED, PLACED ON PROBATION, PAROLED OR PARDONED, OR HAVE YOU EVER BEEN ORDERED TO DEPOSIT BAIL OR COLLATERAL FOR THE VIOLATION OF ANY LAW, POLICE REGULATION OR ORDINANCE? (Exclude traffic violations involving a fine or forfeiture of $250 or less). If a Moral ETP is required, the applicant will FURNISH A COPY OF COURT ACTION OR DETAILED STATEMENT IN AFFIDAVIT FORM AS TO THE OUTCOME OF EACH CASE (to include UCMJ actions). Requests for Moral ETP that do not include proper substantiating documentation of the outcome of each case will be returned without action."

Did you disclosed that information when you enlisted? Did you have to submit a moral waiver when you enlisted? If you did then you’d have to submit one again for this or they may question why you’re leaving it out now. If you didn’t disclose it when you enlisted then they may wonder why you didn’t disclose that information when you initially joined.
