I was placed on the QMP list for receiving a 4 on my NCOER due to a failed weight in. I had multiple broken bones during that rating period. As soon as I healed the weight came off quick. What I found out was until a few weeks ago my unit did not update DTMS or remove my flag. So when I went in fron of the board it appeared I was still not in compliance. 1st can you appeal on this? And I do have appt with JAG and 2nd who reviews it and decides? I know the appeal has to go up my chain of command but that is all I have been able to find out. I too much weight is put on OERs/NCOERs. Promotion or rentention board shouldnt look back beyond or last rank or maybe 5 years at the most. Most civilian employers public or private could care less how you did 10 years ago. The current flag has nothing to do with the QMP...the 4 by the senior rater drove that train.<br /><br />If you did not appeal your NCOER, this doesn't appear to be an appeal-able situation, but you hear many others say to appeal it anyway.<br /><br />If your commanders (company, battalion, brigade) support your appeal, it'll be forwarded to HRC and the Transition Branch should be the ones to review your appeal.<br /><br />Additionally...having been QMPed, you're ineligible to enlist/transfer into the reserve components and if under 18 years, you'll only receive 1/2 separation pay. Now, as far as appealing goes, there is not much that can be done, unfortunately. You see, the military is run just as our bloated government is-- inefficient, and compartmentalized. I appealed a report where my reviewer took revenge upon an eval I was due because I had initiated a compassionate reassingment request, and when the command stalled on the paperwork, I reached out to a Senator for assistance. This is an illegal act, but guess what? Unless that person who takes that route against you admits to the investigating officer, there is little that can be done. I have twice attempted to get this reversed through the ABCMR, and both times... nothing. The disparity is easy to see. I have a memorandum from my rater saying that he was given a direct order to sign the report without question. Common sense goes out the window. Good luck on your transition.
