RE4 from the army (active) trying to go into the national guard. Can it be done with a waiver?

I was a former infantry marine who joined the army active duty, and received a RE4 and uncharacterized discharge (prior to 180 days) for a DUI (on post, no loss of license) in 2015. It’s been three years since I was discharge and the recruiter (national guard) told me I would need a affidavit of the event which I have and 3 letters of reference which I also have, to get into the guard. I have never had any record prior to that other than speeding tickets and haven’t added to the record since. That being said, you think there is any validity to this type of waiver/situation?

As a former recruiter, I find it very surprising that the NG recruiter claims that the RE code 4 is a simple waiver. RE code 4 means permanently disqualified. In other words, there are no waivers. By all means, the NG has their own regulations and they do things differently. However, don't get your hopes up.

RE4 actually means unwaiverable. The usual route is to apply to the Army Board of Corrections to upgrade or change your RE code and then apply with a waiver.

Good on you for staying with it devil dog. Also, Google search “New Jersey National Guard Waivers”; they tend to post updated recruiting memorandums that come through the USAREC pipeline. Stay on top of contacting recruiters; people like us that made mistakes have to really prove why we deserve another chance. Keep us informed if your recruiter helps you out.

I don't know how it would be possible for you to get back in with RE-4 and I was just denied a waiver with an RE-3.

Question: Can the Army Discharge Review Board change my Reentry Eligibility (RE) code?
Answer: The RE code (Reentry Eligibility code) is determined by the reason for separation, not the character of separation.

According to Army Regulation 601-210 (Regular Army and Army Reserve Enlistment Program), the Reentry Eligibility (RE) code can only be changed if an incorrect code was entered. For this type of correction, please send a letter and a copy of your DD Form 214 to the following address requesting the correction:

The RE code is not upgraded to allow enlistment. Soldiers separated with an RE-3 or RE-4 code must seek a waiver from a recruiter to enlist. Depending on the type of discharge and disqualification, a waiver may not be possible.

If however, a former Soldier can provide evidence that the RE code is an error or unjust, the former Soldier may apply to the Army Board for Correction of Military Records for a correction of the RE code. If the former Soldier can provide evidence that their discharge character or reason for discharge issued in the last 15 years are erroneous or unjust, the former Soldier can apply to the Army Discharge Review Board for a discharge review and request that their RE code be changed according to the correct reason for discharge.

The former Soldier may complete an online application at http://actsonline.army.mil and send the signature page and evidence as instructed by the online program ' or - may print a blank DD Form from the Army Review Boards Agency website at http://arba.army.pentagon.mil/ fill in the requested information, and mail it to the address shown on the reverse of the form. Please provide copies of all relevant military records in your possession and any evidence to support your request.

yes YES YES it can be done !!! i'm an example of it! in 1986 I received a RE4 from the U.S.Navy
fast forward to 2004 I was able to re-enlist (as a E-1) and truly do the right thing for my country 16 yrs. later I am a E-7 and run a section in the Tennessee National Guard
