SGT Bergdahl had whipped himself into an almost psychotic state of isolation, from his unit, from his battle-buddies and even from himself. In the end, the enemy seemed more desirable than the mess he had made in his foxhole.<br /> <br />The sentencing of SGT (now PV-1) Bergdahl is now complete. Instead of a 14 year sentence, sought by the prosecution, a sentence of time served, a reduction in rank, forfeiture of pay and a dishonorable discharge will have to do.<br /> <br />Although Bergdahl had plead guilty to desertion and misconduct before the enemy, the circumstances under which SGT Bergdahl was released, the trade of five Taliban leaders notwithstanding, has its own implications of treason. Some have said that Bergdahl has suffered enough, including his defense team. Some say he is not fit to live, let alone wear the uniform. Several witnesses have testified about their war injuries and losses they claim happened because of Bergdahl’s desertion. There were rumors but no evidence that SGT Bergdahl had given the enemy critical information about the unit, its operations and Standard Operating Procedures (SOP). This would allow the enemy to anticipate the unit’s movements and tendencies, potentially deadly information. Some say, while searching for SGT Bergdahl, they were hit and men died. One man, a former Navy SEAL, claimed tearfully that his service dog was killed on one such mission, and others suffered crippling and career ending injuries. It’s all good, but shouldn’t be necessary to complete the project. Bergdahl deserted in a time of war. How do you maintain good order and discipline if you allow folks to just walk away? There is no claim of insanity. There is no plea bargain. There is no excuse. The punishment for desertion can be death.The reason for this goes back to the beginning of human conflict. If you run in the face of the enemy, you have abdicated your responsibility as a member of the group to help keep the group safe.<br />In our own Revolutionary War and subsequent conflicts, such as the Civil War, it wasn’t so much power and punch that won the day as it was which side would run first. Name a war or conflict, and what wins the day more times than not is the will to win or survive. Fight or flight. This is why the American Army is so effective; we are trained that in war the mission comes first. We are trained to never leave a soldier behind. We are trained to be good teammates. But if you allow soldiers to run and then suffer inadequate consequences, what are you telling everyone else who swore that same oath? What then does it mean? In our politically correct, social media, “If it feels good, do it” society, oaths and promises seem blasé and passé. In fact, they are our lifeblood. If we let one instance of obvious and blatant desertion slip through the cracks, what then do we do with the next one, or the next? Kneeling for the national anthem and the absence of even one American flag on the opening night of a national political convention are not simply warning signs, they are signs of the apocalypse that feed the idea that Bergdahl did nothing wrong. That he is innocent of desertion because he was oppressed and that somehow his actions were free speech. It’s not about any of that. It’s about loyalty. The number one most important Army value, and value in life. The acronym constructed out of the Army Values is LDRSHIP (Leadership). The Army aspires to train every soldier to be a leader. In the American Army, even E-Private Zero, Snuffy Smith is expected to carry out the mission if all the leaders above him are incapacitated, in the spirit of Audie Murphy. Murphy, the highly decorated farm boy turned hero from WWII who was battlefield promoted from sergeant to second lieutenant and saved many lives with his heroism, over, and over again, all at 5’4” and 112 pounds, carried on with the mission, time and again. We owe it to the memory of all those who gave their lives in defense of this great nation. We owe it to those who were injured and may have died while searching for Bowe Bergdahl, and we owe it to the future of this nation that Bowe Bergdahl’s punishment fit the crime. But the punishment in this case has not fit the crime in any way, shape or form. The echo from this proceeding will carry far and wide, that the perceived suffering of one man, a deserter, held more weight than the entire history of the military of the greatest nation on earth. Only one soldier from WWII on has been executed for desertion. That was a private in WWII, despite there being 21,000 soldiers convicted of desertion in WWII alone. And there were tens of thousands of deserters in the VN war, and over a hundred in the Iraq War. So the idea that deserters are routinely given a death penalty or severe sentences in order to prevent all the other troops from deserting is just not supported by the facts. And in a way, IMO, it is an insult to the hundreds of thousands of brave soldiers who served or are serving, suggesting that the only reason they stay and fight instead of running away is a fear of getting caught and getting a death sentence or a lengthy prison term. No, he can&#39;t just decide that he&#39;s had enough, he enlisted and has to serve through his enlistment, whether he wants to or not. He can&#39;t quit and walk away, that is what he was court-martialed for.<br /><br />Next, treason is defined by the Constitution of the United States, and the fact that you don&#39;t understand that is troubling. The reason treason was defined is to keep it from being used against those whom are unpopular, to avoid it being used to punish those for which there was a public outcry against. The Founding Fathers had seen the charge of treason misused by the king, which is why, during the entire history of the United States, only 40 people have been tried for treason, with limited success.<br /><br />Onto the desertion charge--first, he was not charged with desertion during time of war, for the simple fact that we are not legally at war. Only Congress can declare war, and that last happened in World War II. The military justice system is not stupid enough to put Bergdahl on trial for that when they can get the same practical punishment for the misbehavior before the enemy charge.<br /><br />Finally, he was convicted and sentenced, after testimony and evidence was presented. I would have liked to see an entirely independent military tribunal making a decision on the facts and the law - not basing their opinion and sentence on the protestations of the leadership of either political party. Like all rulings, military or civilian, they all have consequences. As you can tell I see this as not just a military issue. It seems that in recent history the sentences for various acts of misconduct that make to the news, the rulings are getting less severe. How can a superior officer expect his order to be obeyed if the person receiving the order thinks that there will be little or no punishment for disobeying. I have read all of the comments concerning this discussion, yet no one has mentioned the bigger picture. I served on active duty in the U.S. Coast Guard from 1977 to 1986 and 1986 to 1993 in the Reserves. I was assigned to a unit where the moral was so bad that the Commandant ordered an investigation. Not once during my assignment to this unit (almost 3 years) did desertion or disobedience ever enter my or my shipmates minds. It sounds like in today&#39;s military you are not held to as high of a standard of Loyalty, Duty, Respect, Selfless Service, Honor, INTEGRITY and Personal Courage.<br /><br />I am not privy to the actual proceedings and will not be an arm chair quarterback second guessing the thought process of the military judge, Col. Jeffery Nance. But if it looks like, sounds like and acts like a chicken then it is probably a chicken. <br /><br />I feel empathy and pride for the troops that sacrificed themselves for Bergdahl. I feel the same way about Bergdahl as I did Garwood and find many similarities in the cases. Both had questionable, but brief, records prior to their leaving, or disappearing, from their posts, and both reaped the profits of having powerful politicians on their teams and courts when popular support of the war had dissolved or at least waned. Fortunately, judging from the majority of the responses to the Major&#39;s write up, the sense of duty persists in the hearts of most of us, and the leniency of Bergdahl&#39;s sentence will not have any more lasting effect upon military members as did Garwood&#39;s. True warriors know what is expected of them and will adhere to their self generated expectations of service. In this case the accused was found guilty of a 1day desertion, it was not during a time of war as the current conflict, as all others since WWII have not been declared wars by Congress. There was evidence presented that he suffered from mental health issues when the Army enlisted him. There was evidence of 2other SMS being injured while hunting for him. There was evidence that, once returned, the accused provided invaluable information on the movements, etc. of the enemy which is still being used by our forces. Lastly, there was evidence of unlawful command influence by the Commander in Chief. Having served as a military judge, I can attest that the hardest part of the job is fashioning an appropriate sentence. We are all free to disagree with the sentence adjudged but we must recognize that COL Nance is a professional, well regarded officer and judge. He weighed the permissible factors and made a decision. You don’t have to like it but is lawful and the result of an application of the Rule of Law. Taking pot shots after the fact from the cheap seats benefits no one. The premise of your thesis is that PVT Bergdahl ran away (desertion?), yet in para 2 you stated “He was trying to make the world a better place”. Article 85 of the UCMJ is pretty clear about what desertion is, it involves both an act and an intent. PVT Bergdahl committed the act, but Is it possible he had “not intended” to stay away, avoid hazardous duty, or shirk important service. Are his actions odd, and different from the actions of millions of other veterans? Absolutely! But what if, in his own mind, he thought he was continuing to serve, and was attempting to save the lives of others by his actions? Is that selfless service? Unfortunately, the military has always had deserters but we haven&#39;t talked about it much. During the Viet Nam Era, I worked in the Base Deserter Section at Camp Pendleton. We had over 6,000 case files, mostly from that era, mostly new Marines who deserted after taking leave after initial basic training or advanced training. Berghdahl was different to me because he deserted his fellow Airborne Troopers while in a combat zone. Anyone serving in OEF or OIF knows that it is absolutely unheard of and totally insane to leave a firebase and venture off into the countryside without your weapon, gear, and certainly while unauthorized to do so. This is a violation of General Order 1 and while we don&#39;t have all of the facts, it is certainly likely that brave men and women died and were maimed attempting to save him. While I have grave reservations about the lenient sentence, the whole affair has been political, even if the Army attempted not to make it so. Although justice may not have been served, the Dishonorable Discharge and the presumed denial of pay and benefits during the time within which he was captured and the other penalties like the reduction in grade to private and the withdrawal of his airborne wings and CIB will serve as a dark mark on his life and record that will follow him for the rest of his life. His weak and lame excuse that he had concerns about the leadership is also troubling and ridiculous. There are other positive ways to express concerns about issues in your chain-of-command and as Soldiers or other service members, we have an obligation to be professional and lead by example, not to run away because we don&#39;t like our superiors. I have always been in units with service members who may not have lived up to my expectations but overall, we had NCOs and officers who did the job, did it well, and I witnessed incredible courage, commitment, honor, and leadership in OIF and OEF consistently and in nearly all engagements. Even during Viet Nam War when I had to work with deserters every week being returned to Camp Pendleton, their poor judgment and actions did not appreciably diminish the incredible accomplishments of the fine Marines with whom I served and despite them, the Marine Corps was a great organization overall. The Army did well in every mission I took part in and despite men who fail and despite men who fail us, their nation, their service and in this case, the Airborne, we have prevailed and defeated the enemy continuously in the vast majority of instances. I have disdain for Mr. Bergdahl but I also have pity for him because he had an opportunity to serve in the best Army and combat force we have every had - He got the opportunity to wear an Airborne Tab, Airborne Wings, and a CIB and, he wore the combat patch in a respected and revered uniform of our Army - and than of an elite unit. He quit his Army, he quit his nation, he quit his unit, and he quit his buddies - the same Soldiers who risked their lives to find him and would have laid down their lives in any situation in combat. The verdict is in and I&#39;ll accept it but Bergdahl, most of all, has to live with himself and his failures. He violated his oath and our flag, and all that it represents (including the people of our nation) while he may get sympathy from some in our society, the &quot;warrior class&quot; we all belong to will give him no such support and to me, he will forever reside in a prison that I personally would not want to visit for even one moment. Most people who are convicted of desertion only get prison time often about 10 years or so. So the policy of &quot;deserters will be shot&quot; is a policy that is rarely ever implemented the last person to be executed for desertion was in ww2 and he was the only person to be executed during the war and was the first person to be executed for desertion since the civil war. This is largely in part because it&#39;s hard to convince the general public that running away is a capital offense essentially when much more serious crimes like murder, and rape carry the same punishment. So to come full circle with this statement. Is Bergdahl a deserter? Yes. Should he be executed? No . Unless you want to set and example going forward. Should he have gotten a harsher sentance? The true questions are how did this Soldier manage to walk off base without anyone seeing him in broad daylight? In the summer time, I know the sun was out at 6 in the morning. What were the Soldiers at the gates, towers and NCOIC/OIC doing when he was walking away? Due to insider attacks by Afghan troops, I don&#39;t foresee Afghan watching gates without American presence. Once again, you have all this 360 degree security, but nobody saw nothing, odd right....... Even if he was to cut a hole in the hesco barriers, someone in one of the towers should have seen him and called it up. From reading different articles of accounts, some said when they checked his room, he was missing compass, others say bottle of water. Never did anyone mention anything about if he took his weapon or left it behind....... Now you have a Soldier and weapon missing.......... They were part of a team that invented a gps like tracking device that is the size of a grain of rice. It is injected next to the carotid artery and holds a small explosive charge that if tampered with or commanded, goes off. Its a small charge just designed to make the person bleed out internally. It can be placed without the patient knowing its there. Drug them until they pass out, inject it under the beard, and put them back in the cell and they don&#39;t know there tagged. They are then tracked by satellite. Yes, Bergdahl brought most or all of his troubles on himself. There was claim that he was trying to reach a higher headquarters command post when he left. While you may find it bs, there is no way to know how much credence the judge may have given the claim. The other charge, misbehavior before the enemy, could be interpreted as any number of things, not all of them about running away. Depending upon what the misbehavior was perceived to be could have had an effect. Lastly, there was no evidence that his capture by the Taliban was anything other than unfortuitous. If there was no proof or admission that he gave crucial information to the enemy, there would only be the 5 years he spent in Taliban hands, with some evidence that it was a rather unpleasant experience. I realize that for many of us that does not balance for those lost or injured trying to find him, etc. Apparently, it may have had some effect on the military judge. While even I would admit that the sentence was on the extreme end of the scale, it was within the reasonable realm of possibility, even if you severely disagree with it. The South Vietnamese officer executing the NVA soldier with a handgun or the naked children with napalm burns will always represent the resistance and confusion about the Vietnam War. I am afraid Bergdahl will be representative of the current war because in spite of all of the selfless service of military service members, will represent how our nation just doesn’t get behind wars anymore. The Afghanistan War could have been a short and well defined response to 9/11 but instead it turned into the longest war in our history. Civillian leadership of the military works when conflicts are well defined and short. Anything more results in pundits creating media that undermines the statements of our leadership.
