I don't think anyone really disagrees with that concept. However the major problem is that Prosecutors have been perverting that concept and going after private property which "might be related to" crime.<br /><br />There are cases where professional gamblers are pulled over driving through states, and had their winnings confiscated by local municipalities without any sort of judicial oversight. There have been countless cases of homes being taken in PA, because a drug deal might have happened there.<br /><br />Civil forfeiture, if used correctly, with proper judicial oversight could be a good tool. However, if used incorrectly.... is a flagrant abuse of power. Unfortunately, correct usage &amp; proper oversight are two things that are really hard to come by in government organizations.
