Was I wrongfully stripped of my promotable status for being investigated for a false allegation?

Here's the situation, My ex wife called IG and filed a false allegation against me saying that I committed adultery during our marriage. I was flagged and lost my promotable status. After the Investigation the findings came back unfounded, however; my promotable status was not reinstated. I was told that I had to go back to the promotion board to get it back. I looked into it and asked around from what I gathered, it is up to the first sergeant and company/battery commander. I am about to graduate Basic Leader Course and I was curious as all of your experience in a situation like this. Also, during the investigation, I maintained my military bearing and stayed professional. Any and all opinions welcome! Thanks in advance

AR 600-8-2 Chapter 2, Section 2-1, Subsection E: "The suspension of favorable actions on a Soldier is mandatory when military or civilian authorities initiate any investigation or inquiry that may potentially result in disciplinary or adverse administrative action. Commanders, general officer staff heads, and heads of HQDA staff agencies (to include the DA Suitability Evaluation Board) must ensure that favorable personnel actions are suspended in accordance with the criteria contained in this regulation"

Promotable Status is a Favorable Action. If your "P" was taken, then yes you would need to re-visit the Promotion Board.

A suspension of favorable action does not automatically include removal. You need to visit your S1, retention and IG to see what you can do for yourself. Help the unit help you. Thank you for your service.

As a future leader, and especially as a current BLC attendee, you should be familiar with researching regulations.
In this case the answer is in the promotion regulation. Look under 3-30. You need to become very familiar with this regulation if you are going to have junior soldiers you're in charge of.

The current promotion system wouldn't allow you to be pinned without BLC.
Push for honour grad and show your leadership that you're still promotable.

I had a similar case on my unit...where I had a SGT that was promotable before she got flag, like you all stated she lost her “P” status. Once her flag got remove, since it was “ close closed favorable” . I personally went to S1 and I had her “ P” re-instate. Basically is a two step process.

You got to make sure that when your flag got initiate, the box that stated “ deny auto promotion”, if that block was check, you won’t be able to gain your promotable back, even if the case was closed favorable.

I would request an IG inquiry since been under investigation doesn’t require to remove your promotable status. A FLAG, yes! It once the investigation is over you go back to business as usual.

This is a complete butch of crap. Go to the IG and tell them you want a transfer.
