The initial officer is relatively new to the job and pulled him over for not having a tag. The temp tag is clearly visible in the rear window but considering this started on an unlit roadway it is possible he couldn&#39;t see it at first. The LT drove to a well lit area for both his safety and theirs and considering how this went down the well lit area allowed the video to be clear and showed everything that happened warts and all. A senior officer responded because the first cop escalated the call to high risk. The biggest issue is the contradictory commands being shouted by both cops. The LT froze in place because one cop is screaming keep your hands in view and out the window while the other is screaming to exit the vehicle. He can&#39;t do both at the same time and also reach down to unbuckle his seat belt. They were jacked up and as soon as he brought his hands down to his seatbelt somebody could have fired thinking he was reaching for something. The best thing he did was freeze in place.<br /><br />The senior officer escalated this situation and kept threatening the LT. <br />I have always disliked Virginia Law Enforcement because there has always been a negative vibe towards Military. They go out of their way to harass and punish military members. This is an example of that.<br /><br />An internal investigation was kicked off immediately because they knew this was a bad stop. The Senior cop on the scene was fired and this LT is probably looking at a wealthy settlement because nobody wants this to go to trial. The Department probably got very lucky and was able to avoid a potential bigger problem in the future. Case closed as to who was in the wrong or right. He did nothing wrong. In fact, police often encourage citizens to pull over into a well lit area if possible, even when being pulled over by the police. There are instances of people pretending to be police as well. <br /><br />Even if they claim they didn&#39;t see the temporary tag in his rear window in the cruiser, they&#39;d have seen it when they got out. So there was no need to go up to him weapons drawn. No need to pepper spray. He was 100% right to say &quot;Can I unbuckle my seat belt&quot; because had he not, they probably would have shot him. Then that cop saying &quot;you&#39;re gonna ride the lightning.&quot; That cop was looking for a reason to do something. <br /><br />Also getting release with no charges or a citation - and the one cop got fired. The officer turns on the lights and may use the siren to signal to the driver to pull over to the side of the road. The person should try to find a reasonable stop as soon as possible to avoid the appearance of eluding the officer.&quot; <br /><br />The person should try to find a REASONABLE STOP. He was in no way eluding the officer. He, from what I have read, drove slowly with his hazards on until he got to the gas station and pulled in. Multiple. Never anything like this. Yes, it is possible the LT could have been more compliant. Yes, he DID drive a SHORT period extra to get to a well-lit area. Both are true. BUT....<br /><br />The LT was overall compliant, his action to drive to a well-lit area is ROUTINE and even encouraged by most PDs. The LT never once escalated anything nor did he return the Officers&#39; escalation. He remain calm throughout and the only &quot;struggle&quot; he provided was resisting being thrown to the ground - which I think is a pretty natural reaction.<br /><br />It is a popular opinion that we should just comply with the police, no matter how badly they abuse us or violate our rights. I do not happen to agree with that opinion. I have absolutely nothing to hide in my home. When the cops come by, they do NOT have permission to enter. I have absolutely nothing to hide in my vehicle. When I get pulled over, they do NOT have permission to search. And they get nothing other than license, registration, and insurance. When you are pulled over, you should comply with the Police Officer&#39;s orders, regardless of the fact you believe you have done nothing wrong. You have no idea why the officer might have pulled you over. A vehicle like his may have been identified in another crime for example in which the Police might have been told the individual was armed and dangerous. His actions were perfect all the way up to the point where he continued to constantly question the officer&#39;s need to have him step out of the car. Ask yourselves this question, as military members, would you have done the same as the LT in this situation and not get out of the car as instructed? I wouldn&#39;t. <br /><br />This makes me wonder as well, with all the pressure and spotlights being placed on our nation&#39;s Police. The standards they have to live by is incredibly high, in which many outstanding officers are stepping down because there is little recognition from many in their communities of the challenges they are faced with. Is this in essence forcing the Police to hire or even promote less qualified candidates? Is is affecting the leadership within the Police Departments by causing many to retire early as they don&#39;t want to be caught up in some misconstrued mistake? In the past, virtually every politician would rightly state; 1. Due process is essential, let the investigations pan out and do not overreact before we know the facts. 2. Becoming a Police Officer is a call to service and they should be given respect for that service. 3. Initially I am inclined to trust an officer, especially when all I know between an Officer and those which they arrest, is that the Officer entered into a service bound by an oath to protect and serve. As I learn more about the individuals who challenge the Police and the facts leading to what they did, my faith in that specific Officer may change but never the institution of the Police.<br /><br />My rule of thumb, follow the instructions of the Police, don&#39;t make their job harder, if you think they are being irresponsible, record their actions, and ask witnesses to do the same (ask if they have their own camera on). Instead we are watching people who are clearly breaking the law, resisting arrest, and threatening Police Officers get the benefit of the doubt, expecting the Officer&#39;s actions to be 100% perfect. My fear is that fewer and fewer people will want to be Police Officers and the quality of our Police will suffer even more. This is why despite the poor actions of a very select few Officers should never lead us to disparage or disrespect the institution of the Police and the sacrifices they make everyday trying to protect us all. After they approached that vehicle and his hands were outside that vehicle with a reasonable explanation as to why he continued to a well-lit location they should&#39;ve stood the f@##% down. I am 30 years military, former MP and former federal agent and grew up in the hood where there were no white people. I have provided sworn statements on officer&#39;s misconduct but I tell LEOs; it is open season on cops and with body cams and phone cams, you have to be extra alert and on your Ps and Qs. It is not worth it losing your career or going to prison over a non-compliant subject. My cousin (who is half Puerto Rican and half Bahamian (and did not look white) was murdered and burned by people who were not cops or white in the South Bronx. I wish people would protest over the senseless murders of non-whites in our inner cities daily. And if we want cop encounters to go down; then do not break the law and you will live in peace in this country; no matter what your skin color. He acted ignorant and used his uniform as an attempt to better his position because he knew he was in the wrong from the time he got told about the plate the 1st time he was caught doing 54 in a 35mph zone on a foggy morning. <br />When the police attempted to stop him he should have stopped. Because he didn&#39;t the officers assumed he was fleeing from them. This changes the entire dynamic of the stop from a simple license plate violation to a felony traffic stop. This is done because it is possible that a person fleeing the police has done something bad. <br />Once he finally pulled into the gas station and stopped. All he had to do at that point was obey the officers commands, had he done this it would be a non-event. The cops would have asked him why he didn&#39;t stop and he would have told them. They would have told him that was a bad idea and that was why he had guns pointed at him. They then would have given him a verbal or at worst a written warning about his tag. He would have gone on his way better educated to avoid those things in the future. <br />I honestly believe the whole thing was an attempt by him to get a big payday for himself. Also, he is a National Guard soldier working in VA but from GA. Maybe he&#39;s on orders to the National Guard Bureau. The video from the 1st traffic stop shows his arm patch clearly with ARNG Honor Guard which is the Army National Guard Honor Guard. I have advised many people who have asked what to do if being pulled over at night on a dark road.<br /><br />My advice was to slow down, put on your emergency lights, call 911 to have them tell the officer what you are doing or somehow signal to the officer that you at least acknowledge their presence. It seems the LT did some of that. <br /><br />Added to the fact that the officer claimed to be conducting a felony stop. You don’t do felony stops with just one officer nor do you approach the vehicle - you order the suspect out and have them walk backwards to you.<br /><br />I’m a proud veteran but have become less proud of my profession after the military. There needs to be a nation wide training standard that all dept adhere to. Everyone is trained the same. It is customary for vehicle&#39;s that are being stopped to slow down, put on their hazard lights and proceed to the nearest lighted place. All police are taught this. The original officer erred by telling dispatch that this was a felony stop when the vehicle slowed but didn&#39;t stop and proceeded to the service station. The original officer needs to be retrained in how to stop a vehicle in any situation. I have a great deal of respect for police officers and all individuals within the field. But this police officer behaved like a bloody lunatic. The LT&#39;s fears are legitimate; my brother was a police officer so, through him I know they have to give you a reason why they pull you over. And in this case, the officer did not. The LT was calm and polite. I think (in my opinion) if the officer would have been calmer and gave him the reason without screaming like a maniac, the LT most likely would have gotten out. There was no reason for the police to do any of what they did. And I do not blame the military guy for going to a lighted area and turning on his phone camera. They may have killed him if he would not have stopped where he did. <br />All of this because there was not plates on the vehicle. Yes the windows were tinted but the police could have been shinning the light where the temp lic. is supposed to be and they would have very likely at least seen the yellow of the temp lic. And they never once answered any of his questions. And when they saw the military uniform they should have been a little more decent in my opinion. And when they came up on him the 2nd officer should have checked the back for a temp. lic and that would have ended this or given them the question where is the temp tag.<br />The one cop that said he had been in the military sure didn&#39;t act like it. I was incensed. I was angry. I was disheartened. I would have been confused, too, if I were that young man. The commands of the VA Police officers involved were confusing and contradictory. Neither of them was in charge of the situation yet both of them acted like they were in charge. One officer would give a contradictory command to the other officer and the other officer would inappropriately escalate the situation because HIS commands weren&#39;t being obeyed. I would have been scared for my life had that been me.<br /><br />I don&#39;t know what led up to that altercation (there are two sides to every story), but what I did see was unprofessional and the VA Officers involved were borderline hysterical (not in the funny, ha ha sense but the deriving from or affected by uncontrolled extreme emotion sense). Neither of them had control of the situation and each was overcompensating.<br /><br />I wonder how many other drivers those two have done this to and have been found &quot;justified&quot; in their actions because there was no camera recording the incident.<br /><br />In my humble opinion, 2LT Nazario did absolutely nothing wrong. Not this time. On a dark unlit deserted road, I would not stop for anyone, cops included. There are people who pretend to be cops. They go as far as tricking out their cars to look like official police cars. They dress in identical police and/or state police uniforms. Police advise motorists if they are summoned to pull over, they should turn on their hazard lights to let the officers know they acknowledge them. Then slow down but continue onto a better lit area before pulling over. This officer did nothing wrong. As cops approached they SHOULD&#39;VE told him why they stopped him. Most cops always tell you or at least ask if you know why they stopped you before telling you the reason. The sad thing here is the cops lied. They said the reason they stopped him was due to Improper Tags. Yet on the dashcam video, the tags on the officer&#39;s car are clearly visible &amp; nothing improper about them. If the officer did not release the video, these 2 cops would still be on the job harassing other drivers who do nothing wrong. Are they racist or do they just hate military personal? What I did notice from the video is that the 2LT did not pull over for the police immediately, which was a factor in the negative reaction he received. 2LT Nazario claimed he felt &quot;his life was in danger&quot; so he pulled in to a gas station a few miles down the road. From an outsider&#39;s perspective, you&#39;re going to be in a much better position pulling over ASAP, not miles down the road. Respect goes both ways and many LE officers are prior military, so if you show them that respect and allow them to do their job, you&#39;ll see a better outcome. <br />I don&#39;t know 2LT Nazario&#39;s lived experience, so I can&#39;t judge him. I&#39;ve been in a similar situation as the Lt in this video in Miami when I was approached by officer around 8pm in the evening just standing on Ocean Drive talking to my friend which happens to be white. The officers gave me no indication they were law enforcement, they did not turn on their lights when they pull in their marked vehicle up when they approached us, nor did they identify themselves as Police officers. If you ever been to South Beach Miami, the officers wear a polo shit without shiny badges so from a far you can&#39;t tell if they are Police officers. When they approached me they immediately accused me of throwing drugs which they were certain they say, however I was standing peacefully drinking a water. While they were making their accusations, one of the officers grabbed me and I immediately pushed him off as I didn&#39;t know that he was an officer of the law since both did not identify themselves. Once I pushed him off of me, they put me in handcuffs as I was apprehensive to the situation. <br /><br />Everything happened in a matter of seconds, they asked for my ID then started asking me questions about who I was and what I was doing in Miami. I answer their questions even though they were treating me like I was a criminal. I was pissed off and told the officer to arrest as I was on order for the Air National Guard which they would of had to contact my XO to explain why they detained an Air Force NCO that was peacefully minding my business when they decided to roll up on my friend and I without properly addressing they were officers of the law before they proceeded to search us. It was a shameful moment as it was Veterans Day and my friend and I served together on Active Duty Air Force a few years back. The interesting point is that that video I saw with was all police cams was narrated by Black announcer, He even thought the Lt was in the wrong. <br /> Bottom line this Lt should not be in the military leading men, if you can&#39;t follow orders you shouldn&#39;t be able to give order. <br />I also noticed that right way someone put a video on about the truth about George Floyd, this had nothing to do about George Floyd for one, two, every one from top police to law makers on both side came out against the over use of force in this case. George Floyd did not deserve to die like he did, however to paint him as saint is so wrong and putting him up as poster child of the ills of law enforcement only makes people like me shake their head and tune you out. I will and did put my two cents in that the officer in the case should be brought up on charges, but each case needs to be judged by it&#39;s on merit. Oh and to be frank, if the officer had subdued MR. Keeping that in mind, it&#39;s not uncommon for drivers being pulled over to &quot;slow roll&quot; or drive under the guise of &quot;finding a space to pull over&quot; to essentially play for time and try to hide drug/paraphernalia and/or weapons so that said items would be located in the vehicle vs. on their person. It also serves as a means to quickly plan to flee on foot or even ambush law enforcement. <br /><br />I don&#39;t know off the top of my head if the 2LT slowed and acknowledged the police by turning his hazard lights on or anything like that, nor do I recall how long he drove until pulling over.<br /><br />For me personally, if I&#39;m stopped, in the process of pulling over, if it&#39;s nighttime or evening I will turn on the interior dome and map lights to illuminate the inside of the vehicle and I&#39;ll roll driver and passenger windows down. <br /><br />In this instance, from the lens of the 2LT, with all the outrage of &quot;cops vs. minorities&quot; that all the cool kids seemed to be doing at the time, I believe that the 2LT recognized an opportunity to both get in the media and lay the foundation for a sizeable monetary settlement. From the video, he was incredibly argumentative and non-compliant. The excuse that he feared for his life from a traffic stop is more worn out than a middle-aged stripper outside Ft. Bragg and equally undesirable. The officers were close enough that when they told him to unbuckle his seatbelt and set out, he communicated his concern (which is understandable) and then the cops told him to do it slowly and not make any sudden movements. This is where 2LT began the E-1 Private babbling of bullshit that sent everyone&#39;s heartrate and blood pressure through the roof. <br /><br />Usually when folks are super resistant to simple commands, there&#39;s a reason for it; like they have guns/drugs that they don&#39;t want to be discovered and complying will sure reveal said items. I mean if a cop is pointing a Taser at me an states something that includes &quot;...ride the lightning..&quot; I can reasonably conclude that he&#39;s speaking about me being tased if I don&#39;t comply. Hell, even junior enlisted can draw that conclusion. <br /><br />Perhaps 2LT earned his Bachelors degree in Victimology at the University of Woke and Oppressed (this is satire so calm down) where one or more of his courses focused on how to bait law enforcement to exercise some level of Use of Force that you can later spin and manipulate to fit your self-serving narrative, it&#39;s like Narcissist Gaslighting of Law Enforcement 101.<br /><br />In the end, I think the officer acted like a complete ass-clown and blew this simple traffic stop entirely out of proportion and he&#39;s the victim of his own actions.
