CPL Private RallyPoint Member 5646461 <div class="images-v2-count-0"></div>I have been reduced in rank after my article 15 hearing and I am suppose to PCS in a 28 days but I am oversees. For some reason my orders did not get scrapped and they are still active. Retention said they should have been scrapped but since they are not are going to see if I can still be sent there. Does anyone know the chances of this happening? Not the way it happens. <br /><br />You get notified that you are pending an Article 15 and then you make an appoint with TDS to go over things and your rights. The JAG lawyer tells you your options and your suggested best course and answers any questions. Then you decide. Most decide to simply take the Article 15. Once it is read by your commander then any punishments in it are imposed ie loss of rank, restrictions, extra duty, loss of pay. They can choose to suspend portions of it. There is no reduction of rank prior to an article 15. Not the way it happens, ever. <br /><br />You should also have been flagged in the system. Obviously something is stuffed up here. <br /><br />The only thing I can think of is that your Article 15 time will be over and done before you PCS. The Article 15 would not prevent you from PCSing anyways unless it happened closer to the time you were due to leave your old duty station. <br /><br />You follow your orders unless/until they are amended or rescinded. THOSE trump your command until changed. You should fall off assignment because you&#39;re flagged. It doesn&#39;t always happen automatically.
