And as an MP, I also thought that once you were charged and convicted either within the Army for a sex offense or through the civilian courts, you were done and gone anyway. So again, I ask how is this even feasible that these individuals are in the service in the 1st place. The legal term of being a sex offender has a wide range of classifications based on the nature and type of offense. <br><br>One Marine I served with was classified as a Sex Offender because of pure stupidity. He had been drinking and was asleep in the barracks, and a girl that he knew from around the base came knocking on his door, she told him that she needed to call for a ride. He thought the girl was over 18 but she had a fake ID.He went back to bed while she "waited" for her ride, and she jumped into his bed and had sex with him. The barracks Duty went into the room and busted him. They found out what happened the MPs came, and he was arrested when they figured out her age, and since 29 Palms is a shared jurisdiction, he also was processed by the state of California. Originally they were going to charge him with felony statutory rape, but after the evidence of her actions came into view the most they could get him for was misdemeanor. He still has to register as a sex offender when he moves to a new area. <br><br>We have to start somewhere when it comes to good ideas, it wasn't that long ago when military members who were charged with domestic violence were finally prevented from having/using weapons. <br> Cpl Ray Fernandez Thu, 28 Nov 2013 11:04:57 -0500 2013-11-28T11:04:57-05:00 Response by SSG (ret) William Martin made Nov 28 at 2013 2:01 PM https://www.rallypoint.com/answers/what-do-you-think-of-sex-offenders-being-separated-from-the-army-asap?n=13043&urlhash=13043 <div class="images-v2-count-0"></div><p>Can someone provide a link?  It's not as easy as it sounds.  There are people who have had sexual offense related convictions and yet they are not on a sex offender list.  Good luck finding all of those SMs.  Some of those service members in the category committed their offenses before or after they joined the military.  Will this be retroactive?  People on the sex offender list should have not been allowed to join the service but who knows.  Also, you must recognized that in some states sexual offenses involve public urination or involving a prostitute which are not even sexual assault.  The Army like to some up new regs yet they fail to say how it should be implemented for it falls on the shoulders of the commander but that is how we screwed so bad with sexual assaults in the first place I think.</p> SSG (ret) William Martin Thu, 28 Nov 2013 14:01:43 -0500 2013-11-28T14:01:43-05:00 Response by SSG Private RallyPoint Member made Nov 28 at 2013 10:16 PM https://www.rallypoint.com/answers/what-do-you-think-of-sex-offenders-being-separated-from-the-army-asap?n=13213&urlhash=13213 <div class="images-v2-count-0"></div>As the military is certainly determined to decrease its ranks I feel it should not just be solely focused on separating sex offenders.  Any UCMJ actions or lack of trainable personalities should be recommended for separation as the inevitable seems to be looming all the time.  We have perfectly healthy 18-25 year old trainees where I am at and currently have more than half graduating annually with temporary or permanent profiles in the Army.  Why would we keep Soldiers who haven't deployed for a job they can no longer do because they lack the will to endure some pain and push through 3 simple physical training events.  Reduction in military strengths can come at a cost and now will be the time we have an opportunity to retain disciplined leadership and service members.  My question to caveat is are any of the other Generals military-wide registered on the sex offenders list that committed SHARP violations.....hmm probably not.  Sipping margaritas on forced retirements and enjoying the taxpayer dollars is probably a good punishment for them.  A service member bearing far less rank is enjoying 10-20 yrs. in beautiful Leavenworth for the same crimes...
