He changed a 3 to an 8 in order to get a passing score. His event grader, an SFC, ended up being the person inputting scores back at the company. The 1SG and CO notified. He was eventually reduced in rank to SPC in front of the whole company while he cried. Once it was discovered, he received a Battalion level Article 15. He didn&#39;t lose his rank, but his career was over. He was out of the military less than 6 months later without being able to reach retirement.<br /><br />It was a shame since this was a high speed individual who excelled in his military knowledge and had been diligent in his duties. I think his problem was that he couldn&#39;t stand the fact that people were being promoted past him. If they are lenient it could be as light as a GOMAR. It gets progressively worse from there. He lied, he forged a document that is official and technically he is malingering. His commander will likely not push for a Court Martial but certain could Article 15 him and in this instance it not be a summarized but a Field grade so he loses rank, pay, confinement and extra duty. And most likely he gets flagged for re-enlistment. I remember once that a SGT/E-5 in my and CSM James Post&#39;s company forged my and his signatures on a Record APFT Card for submission with his OCS Packet. The forgery was not to raise the score, because he actually had scored a 300, but he had neglected to get the PT Card for the packet and the submission date was the next day, so rather than calling one of us to go in to the company to get it for him, he opted to Doctor one up. He was caught by the OCS Selection Board and a Court Martial was the result. I have to give it up for Peanut though, and his total dedication to the special kind of stupid, even up to denying he had done anything &quot;That Serious&quot; to the Court Martial Board.<br />The crime is Falsification of a Government Document. An excellent tool that is grossly overlooked is a Bar To Reenlist. It spells out why the Soldier was barred from reenacting, how long it will be in effect, and the type of discharge they would receive if they don&#39;t shape up. In addition, an Article 15 with suspended reduction in rank, and a forfeiture of some kind may be appropriate. Finally, the first O6 in their chain for command can withdraw their &quot;regular pass privileges.&quot; In plain English, this would restrict them to the base, the PX, and place of worship. Just because you can’t achieve or surpass the Army’s standards all the time doesn’t mean you are a bad soldier. The punishment sometimes doesn’t fit the crime. <br />My last decade in the military was served along side Army pilots. On more than one occasion I saw AFTP scoresheet “pencilwhipped” so they didn’t get grounded. Does that make him less of a pilot? I think not. <br />While I was on an out of state assignment I stopped by to see my aging and ailing father and stayed longer than I should. When I got back to my unit my 1SG and Co worked with me and gave me two weeks of extra duty instead of me having a black mark in my records because they saw in me a good soldier.<br />If your a good soldier then try to work it out. Maybe the soldier in question could of been moved to a different area of expertise. All humans, in my mind, are capable of being kind and somehow good at something. As we may think, soldiers aren’t “supermen”. Although, some are better trained.<br />That being said, some where some time we have all made mistakes in our lives. Most of us are better for it. You have to look at that entire career up to this point and see what other things he has done against regulations, if any. Nobody is truly squeeky clean when you stay for a long time, so his history plays a big part in the punishment as well as the actual &quot;crime&quot; per se&#39;. I would like to know what his motivation for this was. Is he in a unit that is active in an operational status and is this keeping him from participating fully? Is he just simply frustrated with his injury / condition, did he hurt it while in military service ore is this an old pre-service injury coming back, something that would not have kept him out in the first place? The commander would, or should have a talk with the PA or Doc who initially set the profile and determine how it has progressed up to this point, and how it is affecting his duties for starters. Next have a talk with the soldier and determine why this was done and for what reason. Once as much information is gathered, like in an investigation, then the picture becomes more clear and easier to deal with as fairly as can be. I can easily see an Article 15 in this picture, but when weighing out all the information, that could be a light punishment if tailored correctly. How does the commander view things like this, how does he view this soldier and their performance to date. All questions that must be factored in, in order to have a &quot;punishment that fits the crime&quot; so to speak. I see one problem and that would be what is current rank is, as if this is an NCO then it would be looked on in a different way and based on that and that alone, it could draw a much harsher punishment. So, depending on how good of a soldier he is and has been will have have some bearing on the punishment, if the commander has a fair minded approach, it could be letter of reprimand and extra duties, pay taken, and maybe a suspended reduction in rank. Of course should this get out of hand, or is pushed to a courts martial, then it could get ugly. The maximum under article 107 could be; If you are found guilty under Article 107 of the UCMJ, your sentence will not exceed:<br />Reduction to E-1<br />Forfeiture of all pay and allowances<br />Five years of confinement<br />A dishonorable discharge<br /><br />So just on what I know, it could go several ways, but I am thinking at minimum an Art. 15. The integrity issue always comes up as the ultimate sin, especially in the military. If the change was made for a malicious or selfish reason, it’s likely the person will be in significant amounts of trouble. When changes are made to an official record, that official record can determine current and future promotional opportunities, benefits, really serving as the foundation for anything the soldier earns or needs in the future. If it was done to avoid some sort of punishment or alternative assignment, it is still a selfish reason however there may be leeway based on the soldiers personal intent . If it was done on a unintentional platform, I don’t see anything very harsh happening however violating integrity is always the key issue here. I saw this happen in one of my units where a soldier was changing purchase orders to sell materials ordered by the unit on the Korean black market. He was subsequently caught and subject to all sorts of fun remedies. The biggest issue here is the soldier needs to understand that integrity is the foundation of the military. I was in a class once where a female cadet, Ms. Pamela J. Hall lied on more than one DA 2823 to try and save her own behind from being recycled. She put the blame on &quot;dealing with this classmate&quot; that she said &quot;visited her house&quot; and &quot;gave her a package&quot; while she was away during Christmas Exodus. Turn out she lived somewhere in the state of Kansas he lived in Michigan, and the class was in Georgia. She admitted to lying in court much later while being sued for defamation after the commander, Mr. Carl Bergaman refused to have any investigation done (willful ignorance I think they call it) and made an attempt at separating the then 2nd Lt as an enlisted soldier under a chapter 12 without any due process. The girl? She did not get recycled. She moved on to her OBC and until the young gentleman sued her in court for losing his career, she probably did not think another thing about it.<br />So it really depends on the commander and what they want to do. Me, I would have court martialed the commander for that kind of negligence or at least for bad judgement. If an individual alters or amends a document without approval or authority is guilty of forgery. Only person that can alter such document is the issuer. The level of punishment all depends on the severity of the altered document. It may be a NJP or a CM procedure. <br />I give you an example when I was in the Navy, we have LOG BOOKS for Watch Standards have to fill in when visiting a certain area. But some has been caught filling out the whole watch on the 1st visit which we called it &quot;Gun Decking&quot;. They got NJP with restriction/extra duty, loss of pay and or rank reduction along with restriction/extra duty, loss of pay. None went to the CM level. Find out what is really going on. Once you have establish that then address the altering a document. I can not tell you what a punishment should be HOWEVER, you should know this Soldier and you need to prove a point but you also need to fit the punishment with the crime. Or maybe he wasn’t when he did I but he ended up being a huge asset to the team later in the short career that he destroyed. Many Company Grade Article 15s never got to the new unit. A different time I guess and its good to have better record keeping now. I would think a Company Grade Article 15 would be appropriate consequence for this action. Could be a courts-martial, maybe an Article 15. Discharge is possible too. Depends on history of the member (great troop, etc.). Also depends on branch of service and commander involved.
