What is the policy on bringing "Assault Weapons" for active duty service members who are PCSing to California?

Is it legal for Active Duty members with PCS orders to California to bring "Assault Weapons" to California? It seems that each source that I read gives conflicting information.

Edit: I want to post an update on this. In order to bring an assault weapon, California requires that you must have a signature from the base commander that you need to possess the assault weapon for performance of military duties. Thus, it seems like this is a no go.

California has magazine-capacity limits, so I don't know if being in the military exempts you from those limits. I only have two pistols that are "legal" in California, because the standard capacity of the rest of my pistols is over California limits.

If you're going to live off post, forget it. On post it will be up to military regulations, but as soon as you head out the gate you will be in the Peoples Republic of Kalifornia. By the way, I purchased my first Colt AR-15 in San Bernardino in 1972 or 73. I could, and did, actually walk down the sidewalk with it slung over my shoulder back then. Of course, Ronald Regan was Governor at the time. I would not advise trying it today.

Good evening Paul. You wouldn't be able to take any ammunition with you into California at all. The answer is YES to AR style weapons, but you have to first Call DOJ of California at [login to see] and request what is called a MILITARY PACKAGE before bringing the weapon into the State. NO CLASS 3 SHORT BARRELED WEAPONS are allowed unless they are registered. However, as it pertains to the firearms I would get in contact with the local authorities in California to ensure they would allow you to take your firearms. Any weapon brought into California has to comply with that states dumbass restrictions. There is not an exception for service personnel.

Imagine how I was feeling when I had orders to Japan and have 2 suppressors.... let alone trying to PCS to the "American" PRC.
That state needs to just fall off, couple charges in that fault line oughta do it. So sick of CA getting to dictate national crap because they're big and have a bunch of people. Thanks Pelosi, Feinstein, and CARB! As if my car will ever be registered in that hellhole.

2018 CA Compliance

One way to go about owning a modern semi-automatic sporting rifle in California starting Jan 1 2017 is to buy/build them ‘featureless’. What this means is you take away any ‘evil feature’ per California standards. Features include a pistol grip, bullet button, flash hider, collapsable or folding stock and forward vertical pistol grip.

Gun owners entering and living in California are expected to have their firearms in compliance with State Law. You won’t get harassed in regards to AR or pistol high cap magazines because those could actually be for work but you won’t win that argument in regards to your personal rifle. That isn’t going on deployment with you. I recently left there after 9 years and it’s beautiful but the politics and taxes are too painful over time. Good luck

If you can’t change duty stations, I would get communist compliant before going. The DOJ and the lawmakers there are ridiculous. You can’t make enough laws to keep dumb*** people safe.

My suggestion would be to contact the local police departments close to where you will be stationed. They should be able to help you find the information you need in regards to applicable state and local firearms laws.

BTW- The best part of California is any road heading East out of that God-forsaken hellhole.

You are not allowed to "import" any magazines greater than 10 rounds. If you bring in an "Assault Weapon", you must register it with the DOJ before you bring it in. Otherwise, it's a felony and you lose your right to own firearms anywhere.

Part of the reason I left California 18 months ago. It was my Marine Corps birthday present to myself.

Under California law, you cannot purchase ammunition without a back ground check. And if you are not a resident (register your car and get a CA license) you cannot purchase ammo at all except at the range. So figure double the normal selling price for ammo.

If you have a semi-automatic rifle with a detachable magazine you cannot have ANY of the following:
Flash Hider/Flash Suppressor
Pistol Grip (They consider the archangel stock to be a pistol grip so the M1A with archangel is considered an assault rifle in CA)
Forward Pistol grip
Collapsing stock.

If you want to keep your magazines, you had better find a friend who will hold on to them for you until you return to a free state.

If you are somebody who wants to help fight this tyranny, support the California Rifle & Pistol Association, the California Gun Foundation or the California Gun Owners Association. They have multiple lawsuits against the state for violations of the second amendment. One is being considered by the SCOTUS because CA law enforcement is able to confiscate your firearms without due cause and are not required to return them.

My personal opinion, being both a Reservist in CA and a CA native, shhh. Keep that information to yourself and don't register your "assault weapons" in CA. Also stock up on 30 round mags before you move.

As for the military exemption, from what I know, there isn't one. But I hope I'm wrong.

First they are not "assault weapons" as those are illegal for anyone to hold in a civilian capacity. Second, you can make a few cosmetic changes and no longer fall under the unconstitutional Kalifornia laws. I have an AR556 which I bought in Kalifornia that came with an awful "fin" that made it impossible to conveniently shoot. It was legal with the fin. It iw also legal with a Thorsen stock that is much more convenient and gives a grip like my lever action rifle. Not as good as the actual AR design but reasonably convient and no longer meets the Kalifornia "assault weapon" definition. The stock is a definite thing you have to change there are a few other things you have to be careful about. No forward handle. No flash suppressor (but a compensator is OK). Check the rules make a few changes and you don't have a Kalifornia "assault weapon".
