The original Deal with France was for 136 jets of which 36 jets would be delivered by France to India in ready to use condition. The remainder of 100 jets would be made in India under HAL with technology transfer from France.
The new renegotiated deal is for only 36 ready to use jets, for the same price (7.6 billion euros). The jets will be supplied to India through Anil Ambani Defense, which would get millions of euros in tax credits from France. HAL and the Make in India programs suffer loss of crores of rupees in contracts. HAL is a Government of India undertaking.
Government refuses to provide the SC with relevant documentation claiming that such information is not available under the secracy act or that the information has been stolen from Government agencies. The information in question was supplied to the SC by petitioners, who mined the information from the Hindu news, which got its information from sources. The SC claims the information leaked is relevant to the unbiased verdict of the Court.
