A domestic enemy of the Constitution would be someone who lives here in the United States, but who seeks the destruction of the Constitution, whether by war, insurrection, or subversion. What can be done about it depends on the situation. "Situations" in real life are almost invariably complex.

What makes a person a domestic enemy? Simple. If you're republican the answer would be: "any democrat." If you're a democrat the answer would be: "any republican."

Any person who willfully attempts the overthrow of our Constitutional Republic by any means what so ever while living in These United States of America as a member of any branch of the military, a civilian by any means. Anyone who is residing in the country by a legal means and yes illegally here. Basically anyone striving to cause damage to this country by any means.

An example of how a domestic enemy would work surreptitiously would be in the Federal Circuits. Notifying the public of a call to Social Warfare because the other side is reverse engineering the US Constitution. Whether that call to warfare is a self projection or the truth the party would have to file claims proven to be an actor who fits the theory of a fraud on the court with unclean hands. Here is a suspect example currently of those alleging “ Domestic Enemies of The Constitution “ from Orange County California USA.
The Ninth Circuit found ample evidence of discriminatory intent, including an effort to “reverse engineer” a discriminatory law to target recovery residences. That finding was significant, since the legislation avoided any direct references to recovering individuals or to recovery residences that were the target of the law. According to informed estimates, this case cost the City of Newport Beach well over $10 million over the seven year course of trying to defend its actions.
