What regulation covers rank upon transferring to the Retired Reserves?

I have my eligibility letter and have held my current rank for just over 2 years. My concern is being reduced and my retirement pay will be reflective upon that rank. If staying in a few months longer is the resolution so be it however for personal reasons, it makes every bit of sense to retire now.

I have read a bullet comment on a memo that reads, grades E-7 - E-9 are reduced in rank if grade not held for 3 years. I cannot find regulation to support that. Any help would be great.

Depends on when you joined the service.
The shortest answer is that your retired pay will be based on the average of your last 36 months of pay multiplied by 2.5% per year of service, unless you opted for the new retirement system.
AR 600-8-7, if memory serves.

My understanding was that you retire at highest rank held, but you PAY was based on average of high 3 (average of last 36 months). Because there is normally a huge jump in pay between paygrades, that can drastically affect your retirement pay if you have 1 year that is significantly lower than the two other years ($3700~ E6 @ 16 vs $4400~ E7 @ 18+).

I believe to new regulation states 3 yrs. At least that's what they told me last year. I may be wrong.

Never heard of Retired Reserves. Either one is retired or one is in the SRR or the IRR.

It's actually within Title 10 of the US Code. This particular link covers commissioned officers. I saw another for Warrant Officers. I did not see one for NCOs. I would think they wouldl all be the same, but I can't vouch for that.

AR 600-8-19
5–17. Accepting promotion to sergeant first class and above
a. A Soldier who accepts a promotion will incur a 36-month TPU service remaining requirement from the effective date of promotion. The Soldier must report for duty in the position to which promoted and comply with a reassignment order, if issued.
b. Promotion and reassignment will be revoked for a Soldier who fails to decline a promotion based on a concurrent
reassignment and who refuses to comply with the reassignment order or fails to meet the service remaining requirement.
Transfers of TPU Soldiers serving under a promotion service remaining requirement must be approved by the first general officer in the chain of command to preclude reduction or revocation of the promotion.
c. Service remaining obligations are waived for Soldiers selected for separation from unit service and transferred to the IRR or the Retired Reserve under the Qualitative Retention Program.
