What regulations exist addressing barracks room inspections? Currently working night shift and have been up since 1200 the day prior. Went to work at 1600 and got off work at 0430. (I still don&#39;t receive separate rations so I had no meal or mre during the majority of that time). I finally make it home in bed to sleep at 0500 to get woken up at 0630 by an NCO from unit B telling me everyone needs to go outside. Me absolutely tired as hell puts on some civilian clothing and goes outside to find out the MPS will be searching the building with dogs because they suspect drugs. A buddy of mine got called in not for drugs but for a training round from the 30 mm gun which is inert and not even able to fire but that&#39;s beside the point it was under a drawer in the very back underneath several items. They&#39;re gone through his room and searched thoroughly with only the first sergeant and a sergeant first class present. I don&#39;t know what his punishment will be but that&#39;s not my concern. My concern is that I was never even notified of this even happening, they have now ruined my sleep schedule and took them roughly 3 hours to finish. And I have no idea what my room is going to look like when I get back such as my $1,800 headset being thrown against the wall or my PC tipped over because they want to see what&#39;s behind it or my medical records that are in a safe that they shouldn&#39;t be going through. anything in the world they want to go through ruin who&#39;s to say that they&#39;re responsible when I don&#39;t even know who&#39;s going in through my room and I come to find out stuff is broken stuff is out of place stuff is stolen and let&#39;s see if they did want to charge me for something with no MP present and no drug dogs present that alerted the room saying I have something bad. And meanwhile this whole time I&#39;m absolutely tired and have working here in a couple hours again to do probably another 12 hour shift. I lived off post, and was called in to stand in the Bs while MPs searched rooms, then we marched outside so they could sniff ALL our cars. And any the dogs hit on were opened and rummaged through; though most were for ammo and fireworks-I guess the dogs are trained for those too. Also you probably should have also got renters insurance to protect yourself. <br />As far as the damage to your things, report it to your first line supervisor and 1SG. If nothing comes of it after a short time period, then take it higher to your CSM.<br /><br />Yes living in the barracks you most keep your room/space inspection ready, yes when conducting health and welfare with the dogs, they have the right to go through ALL things to include the safe, however, they DO NOT HAVE the right to destroy your things and you “just deal with it”, this is totally unacceptable regardless of rank!!<br />You also suppose to be informed prior too an inspection and coordination suppose to be made since you all are on different work schedules. <br />NO Soldier should deliberately have their things broken during ANY inspection!! You are NOT to know when they happen. The unit that owns the barracks you are housed in, the Command Team knows about them, but the Soldiers are to NOT know. They aren&#39;t supposed to tell people. You are NOT supposed to be in the room when they happen. Your sleep schedule be damned. The MPs with dogs go thru with a representative of the unit (usually the 1SG and/or the Commander). If your medical records are in a safe that is closed and locked, then they won&#39;t access that safe. They won&#39;t even give that safe a second glance unless the dogs signal the handler that something is in there. At which time, you would be called in to open the safe. If something of a personal item gets broken in the search, that is why the representative is present. Paperwork is done later to recoup losses. And stolen? Do you really believe that an MP will steal your shit? <br /><br />If you really want to know what the policy is, just ask your Chain of Command. They owe you no more explanation than anyone else in the unit. I assure you, if your unit knew, they are not allowed to tell you either. As for your sleep, HMm, been to a training exercise, combat, peace keeping, peace enforcement-lately. You need to sit down and speak with a seasoned NCO in your MOS, then take stock of where you are, why you are and what your roll is. Make a decision either way on whether the Army is for you. Health &amp; Welfares are a fact of life. They can occur whenever the commander deems necessary. Nobody is ever going to tell you and considerations about your sleep schedule and personal privacy won’t be causes for it to not occur. It’s the Army, and the Army is a dictatorship (with a few notable exceptions) and not a democracy. If someone inspecting your Room breaks your personal property by throwing it against a wall or tipping over an expensive computer you have a legitimate complaint. You can start with your chain of command and there are a few options for you. One is filing a claim against the federal government for your damaged property. Or file a criminal police report with the MPs. When I was enlisted a fellow Marine vandalized my &amp; I filed a claim against the government and was reimbursed for the damage. Which means that they can walk in day or night at any hour and inspect it etc. Get used to it. <br /><br />The MOST you can do is contact your first line supervisor and advise them of the situation and ask for lenience as far as a reporting time. Also, if there is something broken or missing when you get back in, you should document this with your your supervisor and the Unit that is in charge of that barracks where you are staying. Only time I couldn’t do this was in Korea and when deployed to the sandbox. When they came around for my first inspection in the barracks my Sgt walked in and asked where all my shit was and I told him the truth and from then on if an inspection was gonna happen he just asked if the situation had changed, then sent me home like the rest of the guys who lived off post. If you don’t want to deal with worrying about your personal belongings and less hassle this is an option. If any of your property is stolen or damaged, or if your room is left in any state other than how you left it, I.e. they flip you mattress or take off your sheets, move you furniture, cut a lock and do not find any evidence, then I personally would request MAST because, at least by USMC, regulations they aren’t supposed to disrupt or otherwise disorganize the conditions of your barracks room and they cannot take away your expectation of privacy without probable cause. (4th amendment). Moral of the story, if there’s something you think is a legitimate problem, request MAST to at least bring it to your commander’s attention. The person doing the investigation be it the MP or the representative accompanying should be only allowed to inspect it for contraband items, they should not be able to read through the records as medical records are still protected under HIPPA even in the service, now if there is a legitimate reason for investigation of your medical records, and this is going into a separate issue not directly related to your room inspection, your command would have to have and be able to show good cause as to why they are wanting a review of your medical records. If you want to know what the actual regulations are for barracks inspections and inspection of personal property/belongings you can always call and he IG’s office and ask, you don’t need permission to call them, they will ask for you information once called, but there will be no repercussions for doing so, especially if your chain of command or superiors don’t know them selves or failed to inform you of the regulations. You have found yourself in the unenviable position of working a night shift. Back in the late 70s I was an E-5, working as an instructor at Fort Gordon. We had classes going around the clock. I and my students started class at 2300 at got off at 0700. I was living in the barracks and would routinely be woken up because of whatever and my students would be woken up to clean or do police call when the day shift students were in class. Later, while working on a SATCOM site where everyone but the admin was on rotating shifts, mandatory training events always started at 1000, even though the midnight shift got off duty at 0800.<br /><br />Civilian life isn&#39;t that much better for folks on night shift. Bosses will call to ask a question that could wait in the middle of your sleep cycle. Your neighbors and telemarketers will violate your sleep cycle for all kinds of inane reasons. I wish that I could tell you that there was a way to rectify your situation, but the bottom line is that society, for the most part, works during &quot;normal&quot; hours and most people cannot wrap their minds around how to be considerate of those who work nights. Scheduled inspections can be waived based on individual schedules, however no notice inspections are just that. They don&#39;t happen very often and you just got caught in an unfortunate situation. I can tell you that there are certain operational regulations that require you to have a known quantity of sleep based on your MOS and safety. I was caught up in what used to be called &quot;Golden Flow&quot;, a no notice drug test where you had to pee in a bottle at the hospital. I was called at home at 0730 L and had 2 hours to accomplish this. I had to go in and do this thing however, I was scheduled to fly with my crew that evening and this meant that my crew duty day began with a phone call. My flying duty would have ended at 1930L and my flight didn&#39;t terminate until 0130L the next day. I would become NMR in flight and so I couldn&#39;t fly the mission. There was no other crew member that could do my job (Celestial Navigator) and so the mission was CANXed. The Wing Commander found out about this along with the Ops Group Commander (Both 0-6) and reamed the Hospital Commander for a canxed peacetime operational mission. After that, all aircrew members names were submitted to the Ops CDR for scheculing deconfliction before being tasked with &quot;golden flow&quot;. BTW, I tested negative. I was like you initially, very righteous and I demanded rules and regs for almost everything; such as, where does it say I only need four hours of sleep and in the middle of sleep I can be ordered to report to the 1SG. I very quickly learned that asking these questions was irrelevant because Top has every right to order me whenever and wherever, which I just had to suck up and drive on. If you do find an ear somewhere, 1SG will simply say he is training you and growing you to become an NCO, at which time you are in soup with your 1SG. Being in your 1SG&#39;s soup isn&#39;t funny, it is extremely painful. Think, if 1SG is this bad then, CSM would definitely be worse. <br /><br />Health and Welfare Inspections are Army 101. These are conducted, when there is even a slight whiff of irregular and illegal activity in the barracks. There are always a few living-on-the-edge types, who try drugs, alcohol and other things unauthorized in the barracks. If 1SG can’t get resolution then see Legal for advice and assistance.<br /><br />As far as health and welfare inspections go they are part of barracks life. But you will be dammed hard pressed to find someone who agrees that this should be done to on base housing as well. There are some down right nasty folks who live on base.<br /><br />One thing you can do is get with your Post BOSS Rep and see what they can do.<br /><br />When I was at Ft. But, the Chain of Command CAN conduct a Health and Welfare without MPs.<br />As you are residing in Unit B&#39;s building your chain of command would not know about the health and welfare inspection unless the building was split with them. And if they did and told you about the H&amp;W they would be subject to charges under the UCMJ.<br />IF things are moved around doing the search, that happens and you basically have no recourse.<br />IF items get broken then you document that and submit a claim for the damaged property.<br />IF something gets stolen, then you better be able to document that the Inspectors took it before making accusations.<br /><br />For an individual soldier staying in the building you new Chain of Command would not be involved.<br />When I had my Battery (ADA), the PAC occupied my 4th floor, so when we did a Health and Welfare their Chain of Command were present for the portion of the building being occupied by them. I do understand your viewpoint. I was an enlisted soldier and a SGT before I earned my commission. Your room in the barracks, whatever unit owns it, is NOT a private space for you. You have no expectation of privacy or fixed hours of sleep or fixed hours of duty. And you have no reason to believe that you can keep something &quot;private&quot; in a safe in your room. When I served, there were no safes allowed for anyone except the Army. A soldier could not lock up or conceal anything in a private safe inside a government-owned building. It&#39;s all about the needs of the service. If an inspection reveals illegal items (like a 30 mm training round) in a soldier&#39;s possession, then you can expect the command to look further. I do understand your distress with valuable personal property being damaged, but you don&#39;t have the right of approval or consent to inspection of your quarters. I wish you well, but until you earn the right to live in government quarters or off post, don&#39;t expect the right to privacy. If its done by the unit, its more than likely an inspection to see how the soldier is living and often times, the soldier is standing there while the inspection is taking place and to allow the inspector to ask questions of the soldier. Also, since the command is aware that the soldier may have just gotten off duty, he\she may be one of the first to be inspected, so they can secure their items and get some rest.<br />Keep in mind, during any inspection, the person conducting the inspection, can not just go through and take things out of place or throw things around the room. Any item removed, would need to be place where the soldier can place the item back to its original location. The same thing happens when the MP&#39;s come in with a dog and want to go through several rooms. They know what rooms they&#39;re interested, but they may choose 4 rooms on the 1st floor and 6 rooms on the 2nd floor, which the rooms they enter, will include the room(s) of interest.<br />Also, if 2 or more people live in a room, they all would be present while the room is being inspected and should something illegal be found in the room and no one owns up to its belonging, everyone in the room will have a chance to speak with &quot;JAG&quot; prior to any punishment being handed down. But, if one person owns up to the belonging, that person, still has to see a JAG Officer, prior to any punishment being handed down. If dogs are an issue, and cause unnecessary hassles, do as we did. Take a sandwich baggie, and place pepper, chilli peppers,garlic, and anything else you can find that is extremely spicy under a wall locker or other furniture near entrance to your room. Do not get baggies that seal shut, this will ruin dogs sense of smell for several hours, and it takes several rooms past yours for MPs to figure out the dogs nose is dead, so to speak. We had to have cause to actually go through draws or closet and use anything for evidence. If we felt there were drugs then we would have security people come in with their dog. Asia 10/1967-10/1968, then my DD-214.<br />Overseas, they held &quot;contraband inspections&#39; at ANY time, (but yes, MOSTLY at un-Godly hours for a REASON...maybe 0200 hours local time, as an example.<br />Our immediate CO, First Sergeant, and AP&#39;s with dogs (USAF) blocking BOTH ends of our hootch.<br />Our 1st Sgt. yelled &quot;lights ON!...gentlemen!...STAY where you ARE!...lockers OPEN!&quot;<br />NOTHING else is said...the AP&#39;s walk the dogs around our hootch sniffing for &#39;stuff&#39;. <br /><br />FOUND... <br />Some &#39;stuff&#39; (&#39;hardware&#39;...no details here) found in the guy&#39;s locker on the other side of the aisle. They then questioned all of us on who he was, duty section, since we were in the same hootch, etc...I never saw him again, and I didn&#39;t ask.<br />They also looked in and hand-moved stuff in ALL our lockers...vertical areas (hanging clothing), the bottom drawers in our lockers, under bunks, the ceiling &#39;plank area&#39; where we stored our duffel bags for going home, etc. <br />They handled our mail (DIDN&#39;T read), and general search, so we HAD to be there for personal items search.<br /><br />Bottom line, in MY opinion...it&#39;s THEIR (Uncle Sam&#39;s) place, not YOURS...you&#39;re just a resident.<br />AND...you never KNOW...WHO is going to have WHAT, or WHERE...just saying.<br /><br />Again...MY opinion (I can HAVE one now...LOL)... If it is a government surplus item, then be sure you have a receipt for it. If you are search then can only look in the general area. But to look in private and personal areas must have a search warrant presented by the MP&#39;s and conducted by the MP&#39;s.. Someone needs to understand that while in the service, you are on 24/7 365. Your time is not your own, and if the local authority needs to do an inspection, in the barracks they provide for you, deal with it. Last I heard the enemy doesn&#39;t go on your clock, CONUS or OUTUS you deal with the adversities. Try having General Quarter drills lasting 2 plus hours 3 or 4 nights in a row. If you can&#39;t handle disruption in your schedule, find an hourly job that might not be there for you. Only thing I can think to add is &quot;want a little cheese with your whine&quot;.
