According to AR 670-1, 3-7k:

k. Wearing Army uniforms is prohibited in the following situations:
(1) In connection with the furtherance of any political or commercial interests, or when engaged in off-duty civilian
employment.
(2) When participating in public speeches, interviews, picket lines, marches, rallies, or public demonstrations, except
as authorized by the first O–5 in the chain of command.
(3) When attending any meeting or event that is a function of, or is sponsored by, an extremist organization.
(4) When wearing the uniform would bring discredit upon the Army, as determined by the commander.
(5) When specifically prohibited by Army regulations.

You never know though, however remote the possibility , perhaps there was some sort of official aspect about it, one would certainly think such a major and clearly well known prohibition would be so generally clear, that, one might expect there quite clearly must have been some advance cognizance of that whole aspect, just a thought and some idle musing, for whatever it might be worth, though I of course understand the reaction overall here of apparent surprise, certainly I'm just saying the rule is obviously so well known that there might possibly have been some basis for justication quite possibly, that's all I'm trying to point out, for whatever it might be worth, though, at the moment, I can't envision certainly what that might have been, that's all I'm trying to suggest, many thanks, hope was of use if only for consideration, certainly.

There has been a number of people in uniform at his rally's. I say "people" because of the immense, blatant misconconduct called stolen valor. Tons of dirtbags getting called out on their crap by un-uniformed personnel at trump rally's. There have been some videos out on the inter webs of soldiers confronting these knuckleheads too. PO1 Robert Teague There have been some great comments as to the depth of poo that the officer would find himself in should he be identified. I am going to take a different approach to this. Looking at the picture, this individual is relatively close to Mr. Trump, and in a position where common sense would have said "I am going to be on film." So what would be the ramifications if this person is a paid actor, whether former service or not, who was paid to stand in the background, in a uniform, and look like he is in support of Trump? It would give Donald the appearance of a military endorsement without having to come right out and say it (since we all know the military will officially remain neutral in political elections). I am not saying that is the case, but it would be interesting. I definitely would not put it past any of the front runners to use paid lackeys to make them look more appealing to voters. Military in uniform is almost as good as a baby with his two job having single mother.

Agree fully with all who have stated that this is a big no no, and should this individual be an officer, and identified, he will have no ass left to hold him in a chair.

Well, this is not a political rally. It's a Town Hall meeting which "is an American term given to an informal public meeting, function, or event derived from the traditional town meetings of New England. Typically open to everybody in a town community and held at the local municipal building, attendees generally present ideas, voice their opinions, ask questions of the public figures, elected officials, or political candidates at the town hall." Of course, with current technology and media it has taken some different forms. However, these events are technically not in support of a candidate. Now if we saw this guy at a Trump rally, then he would be in deep scheisse. But this is pretty much a simple political meeting.

Colonel Stevan French at the Rubio rally in Houston. I confronted him and he tried to tell me he had it approved by his PAO and tried to tell me to move out. I asked him his name and he added his unit. So I contacted his boss which was a two star. This guy was even giving on camera interviews. He was there just to soak up hand shakes.

It's not a commentary on any of the candidates, but I was really annoyed by Tulsi Gabbard appearing in uniform as part of a Bernie Sanders commercial. It's not about whether or not I like a candidate, but that we should never give the appearance of lending the military's support to any particular candidate. Civilian control of the military is one of the best things about this nation, and I would never want even the appearance that we attempt to influence a vote *on behalf of the military*.

AR 670-1 is only applicable when he is on active duty. Inactive ready reserve subject to recall, like most retired officers are or completely released for medical reasons such as myself can not be held accountable to AR 670-1. There is no prosecutable federal law that prohibits the wearing of military uniforms anywhere or by anybody. There are non enforceable statutes that are similar to a military Field Manual. They tell you how its supposed to be done, but aren't criminally enforceable or prosecutable. Even the wearing of military badges, emblems and uniforms by individuals who have never been in the military has been determined to be free speech by the courts. So in a nutshell, unless this individual is on active duty or is gaining something of monetary value by pretending to be something he isn't there is no actual criminal law he is breaking and he can keep right on marching on.

This is not the first time this takes place, not the first time individuals or whole chain of command make the decision of violating doctrinal guidance and it will probably not be the last. Very often these days uniform personnel fails to read and learn about doctrinal guidance and often makes bad decisions and/or poor choices. "4.1.2. A member of the Armed Forces on active duty shall not:

While in the Marines I didn't even vote. I signed the line to follow all orders within moral reason- not debating that now. I was there to do what I was told. Once out I resumed my place as citizen, voter, etc. I would have fought to the death for whoever was the elected Commander in Chief - and those in my chain of command. I know it might be against regs, but if you think about it, you guys should be able to wear your uniform anywhere you want. Some rules are just stupid. This is one of them. Who cares, if you serve this beautiful Country you should be able to wear your uniform and ribbons earned. As long as the specific function and location are not disrespectful to the uniform, service members protect liberty and wearing a dam uniform one earns should be allowed. In addition maybe if more people wore their uniforms around more of our fellow country men and women would join or support the military.

Is he actually a military member?
Is he on some kind of official task? Perhaps he allowed himself to get caught in the picture.
Is he retired? In which case, I still think it in poor judgment to wear and a political event. We all go through the briefs. We know we are not to attend political functions in uniform. This could be portrayed as the military's or Army's endorsement...which may be what Trump is trying to do.

The military is neutral to the political process. Wearing your uniform gives the impression that the military endorses whatever candidate. You wont see the candidate complain, but your ass will be in a sling as soon as the unit learns of it.

When you put on the uniform you represent the U.S. military (unless you are there in an official capacity). In that capacity we must remain neutral. The mere presence of a man or woman in uniform at a political event implies that the military branch for which they represent supports the candidate (in this case Donald Trump).

AR670-1, para 23-2(b) prescribes those situations in which an ARNG or USAR Soldier not on active duty can wear the Army Uniform and a partisan political event is not one of the authorized occasions for wear. In fact, DoDD 1344.10 provides that Servicemembers can "4.1.1.9. Attend partisan and nonpartisan political fundraising activities, meetings, rallies, debates, conventions, or activities as a spectator when not in uniform and when no inference or appearance of official sponsorship, approval, or endorsement can reasonably be drawn." The Soldier in this case not only violated the AR but the DODD states "4.6.4. This is a lawful general regulation. Violations of paragraphs 4.1. through 4.5. of this Directive by persons subject to the Uniform Code of Military Justice are punishable under Article 92, “Failure to Obey Order or Regulation,”" This isn't the first person nor will be the last who thinks it's OK to wear the uniform to support a candidate or lend the appearance that the US military supports a particular candidate.

Yay, everyone condemning this action is literate and capable of reading regulations. But guess what? Who cares? The rule about politics and uniforms was written during a time when service members did not have to worry about crappy service at the VA. It was written at a time when you could trust your politicians would not lie to the public to get support to go to war. It was written at a time when politicians cared for the military. Now that we don't live in that time anymore, service members have to look out for themselves since the DoD and the VA won't do it. If I wasn't currently deployed, I'd be sitting right next to him and dare anyone to do anything about it. So, feel free to get up on your soap box, quote a reg or two if it makes you feel better. It still won't stop this guy or anyone else who feels motivated enough to take a stand for something. I applaud this guy for his testicular fortitude. I'd put money on a bet that says nothing happens to this guy.

The law is pretty clear about this. By ethical definition, the military does not involve itself in the affairs of state. Thats too much power.

That end... military members cannot be there in an official capacity. When you are in uniform you are in an official capacity.

4.1.1.9. In general a servicemember may attend partisan and nonpartisan political fundraising activities, meetings, rallies, debates, conventions, or activities as a spectator when not in uniform and when no inference or appearance of official sponsorship, approval, or endorsement can reasonably be drawn.

To everybody here who is confused, even if the officer is a reservist he is still in violation of DoD Directive 1344.10 (2008). Paragraph 4.1.4 spells out that a reservist is allowed to participate in the activities permitted and forbidden to active duty service members provided that the reservist does not do any of them in uniform. I think that's pretty clear.

Policy sees the uniform as official endorsement, period. Also, to the sea lawyers calling this a town hall and not a rally, the directive treats everything from a debate to a partisan meeting to a nonpartisan political meeting the same way, so that's no help.

I'm late to this, but it takes a little time to toss that uniform on. It's not like he shuffled out of drill or his duty day ended and he was late for this, he's seated in an arranged spot so he could be seen. He wasn't strolling by and stopped to observe for 3 minutes. I hope we find out more.

Is a town hall a political rally? They had town halls with several candidates, the tone of what I saw on TV from these was not a political rally, it was more of an interview -- I'm not certain the Hatch act would apply, though I'm not a JAG and I certainly wouldn't do it without some clear guidance on the issue.

I can't believe anybody in uniform or whoever wore the uniform is concerned about this issue. You should be worrying about when that sorry piece of garbage leaves office. If you have not noticed over 200 top echelon officers have been purged by this president because they don't share his liberal believes and get labeled as being un-loyal. I don't hear one word about the Army, Air Force or Navy personnel wearing camouflage utilities out in town, nor do I believe anybody in these branches ever heard of an iron.

Whenever you are in uniform you are a representative of the military. An officer should know better. If this is a military member it he is definitely in violation....but in this day and age with so many "pretenders" (e.g. Stolen Valor) individuals out there that are "protected" because of there 1st Amendment right to impersonate one of our brothers or sisters, I'm surprised this is not a more common accordance. If you are going to mention this, don't be hypocritical and not talk about the West Point cadets holding up the black panther salute IN uniform. In the military, we are supposed to be neutral to politics. This includes disparaging those with opposing views. The military has no place for either the left or right wing agenda. We defend the Constitution, not the political party or the politician. Please refer to your oath, which used to mean something, as well as your code of conduct both in and out of uniform.

For this reason to date I still stray away from political discussions unless it's with immediate family members. I learned my lesson along time ago that even if you are no longer enlisted people still associate your political opinions as being that of whatever branch you served. I grew up in a Military Family and a lot of the political talk was kept to a minimum.
