I got out with RE-1A code which allows me to re-join another branch. Did government contracting for the duration of attending school online. Claim VA throughout this process and received a 40% rating. Got my Bachelors Degree. Looking to go back into military as commissioned. I contacted the VA to "terminate" benefits, they told me to submit form VBA-20-572, form submitted and no longer Receive Direct Deposit. Went to private doctor and got cleared of full medical from top to bottom - fit for duty, intense training.

My question is: When going back in, do I need to disclose anything with VA since I am no longer receiving it? When going back in as prior service, do I need to disclose any previous disability with VA if I am no longer receiving it? 2021-01-08T00:55:10-05:00 Cpl Johnny Willis 6641207

Prior Service - VA Disability Stopped, Re-joining military. Failure to do so may constitute fraudulent enlistment. As for telling MEPS about the disability rating itself, I don't think you need to say anything. The doctors will assess any problems you have against the regulations and determine if they are disqualifying. The DoD and VA have completely different sets of criteria -- no need to muddy the water since you have suspended your benefits.
Also, let the VA know when you get out and remember that if you get any sort of separation or retirement pay when you get out it will affect the amount of VA benefit you receive even if your disability rating remains unchanged. Either seek out a VA representative and they’ll be able to assist you with filing the form to stop your pension, or you can find VA Form 21-8951-2 on Ebenefits, complete the form, and submit it to the VA yourself to stop your pension. After you’ve submitted the form, you’ll need to inform your recruiter that it’s done to continue the enlistment process. You must be completely honest about your physical condition. If the Army asks about previous injury, hospitalizations, illness, etc., you must be absolutely honest and accurate. You can note that the condition has been overcome. Since you are not getting anymore VA disability compensation and are just getting your AD pay, I think you are in the clear and don’t need to report anything to the VA.
