When is a demoted Soldier eligible for promotion?

I have a Soldier who was a SPC and demoted to PFC after a Field-Grade Article 15. This Article 15 was read and he began carrying out his punishment in December 2014 - January 2015. His flag was lifted around March 2015. My question is where the TIG for the new rank (E-3) begins, is it from the date of the reduction or the date of the flag being lifted? I am trying to determine when said Soldier would be eligible for promotion. I have not had any problems/issues with him and he is a hard-workers and great asset to the team, I don't want to see him forgotten. Thanks

CPT Michael Moffeit I don't know the ins & outs of Army, but his Date of Rank will be the date he was reduced, and therefore his Time in Grade should begin on that same day. He may not be "eligible" until based on that same criteria however.

This would be a great question to take to your "S-1" Shop. If you are doing reviews, Pro/Con's, or whatever they call it, you don't want to mark him eligible for promotion --esp. if the s/he isn't.

The reduction would establish a new date of rank from which time in grade would be calculated from. So barring any FLAGs or other impediments, the Soldier would be eligible 6 months from the effective date of reduction IAW AR 600-8-19.

Thank you all for the responses. If his DOR is the date he was reduced then he is definitely past due for promotion back to SPC. Absolutely something I am going to push with S-1 ASAP.

The date of the flag going into effect should probably be the same day he was demoted. That's his new date of rank, so whatever the TIme in service and time in grade say for E4 (about 6 months I believe). So, 6 months from the effective date of his reduction.

IAW AR600-8-2, Soldiers become fully eligible of all actions revoked by the flag, but reset of DOR (if rank was taken) should be considered. However (comma), he/she must meet the eligibility requirements of AR600-8-19 and be recommended by their leadership. This definitely starts with the CSM and goes all the way down to the first line supervisor. I recommend sending the Soldier to competition board to show personal interest in personal growth and development and it also introduces him/her to the board. Additionally, consider the AR15 offense. Should said offense have enduring negative effects on the organization, then it would be wise to play a little politics and let the fire burn out before asking for favorable action. Bottom line: The Soldier should be contrite and humble and ready to rock the board (including weapons and APFT) before puffing their chest out.

I'm not too sure if this has been mention in the other responses to this issue, but one thing to consider is whether or not this Soldier's flag has been properly lifted after his punishment phase. If the flag was not lifted, he will not show up as eligible on the monthly promotion reports. I've seen multiple incidents where a Soldier was held back from promotion due to the fact that the CoC failed to process the flag paperwork after the Soldiers punishment phase.

i dont have a flag on my erb but i was demoted about 5 months ago a week before i went to my next duty station. i haven't got even a negative counseling at this new place. how do i get my rank back im a pfc now
