I am about to be the OIC in a staff position, which will be new to me, and will be in charge of a SFC who received a DUI about 4 months ago. He continues to get out of work because he says he's not allowed responsibilities due to being flagged and being chaptered. Instead he wants to play on his phone every day. Is there a reference I haven't found that states his duty restrictions? Thank You

Damn Chief. Sorry you have to deal with a turdball. Might be time to involve a CSM in the Chain. If at all possible, get that piece of shit away from you and your Command. You would do better off if he was out of your AO and sitting in the Post HQ's linking and unlinking paper clips..

MSG Pat Colby I absolutely understand where your coming from, a bad influence, or distraction is worse then absence.
But do you see value in the unit "SEEING" someone held personally responsible for their actions? For the unit to "see" the ramifications of his actions?

I understand for the Chief it is an increased burden at the moment, and that distraction may end up outweigh the value of having that sergeant present.. But reality is he's going to be somewhere, supervised by someone...Do you think it "fair" to pass on that burden or distraction to another section, unit, leader?
I was very big on units/ leaders/ holding on to problem children not passing off the problem to another unit (unless that was part of the plan to help the SM come up to standards)

I initially misread the original post, but maintain my suggested CoA. The good CW2 indicated he will be the OIC in a Staff Position not a Commander. His RP profile puts him at Ft Riley Kansas. As an OIC, he can and should utilize the Chain to pursue his options. Not quite sure this particular situation is "passing off" the problem. He's just sending the SFC upstairs or across the hall. This is a Command Group issue in my eyes and that's why they make the big bucks.

d. NCO prerogatives and privileges are shown below. NCOs will—
(1) Function only in supervisory roles on work details and only as NCOs of the guard on guard duty, except when temporary personnel shortages require the NCO to actively participate in the work detail.
(2) Be granted such privileges as organization and senior commanders are capable of granting and consider proper to enhance the prestige of their enlisted troop leaders.

It looks like it's been handled for now. My acting Commander was saying just yesterday he wants him to start his appointments right away to get him out of the Army. I appreciate everyone's responses on how I should work with this Soldier until he is out. Only thing now is he was telling me how much money he is going to get as severance for involuntary separation which rubs me the wrong way since he received a DUI and is getting chaptered out. I may possibly be facing a medical board in the near future, and if I get relieved I will more than likely just get medically retired while he receives $80,000 for being chaptered out of the Army. I'm hoping I can finished my last 10 years but just the principle of how some things turn out. Thanks again though for the help!

Chief don't let it bother you... 80k may seem like a lot, but in reality it's barely enough to pay the bills for maaaybe 2 years assuming he doesn't work right away, and whatever he gets from the VA (assuming he files a claim)...that severance is a one-time gig...he's loosing an enormous amount of money...I assume he doesn't have enough time to actually retire (20yrs)...If he had made it to 20....it would be 50% of his E7 pay every month for his entire life and that's a lot dough! :) ...In some of the units I have been in the CSM took on these NCOs....Personally, I'd make him work (Supervisory capacity of course) all the way up to his last official work day...Oh, I think you can get his PTDY and his Terminal Leave Denied...So you may be able to use that to get him back in-line. PTDY and Terminal Leave is a privilege not a right. I know of cases where the Commander denied PTDY/Term Leave for some Soldiers the reason for the denial was that they were mission essential...In Army Medicine it happens quite frequently....
